۱. دولت عضو سازمان، اگر با استفاده از صلاحیت سازمان در موضوع یکی از تعهدات خود، از آن تعهد دور بزند و سازمان را به ارتکاب عملی وادارد که اگر توسط دولت انجام می‌شد نقض تعهد بود، مسئولیت بین‌المللی دارد.
۲. این حکم صرف‌نظر از متخلفانه بودن یا نبودن عمل برای سازمان اعمال می‌شود.

A State member of an international organization incurs international responsibility if, by taking advantage of the fact that the organization has competence in relation to the subject-matter of one of the States international obligations, it circumvents that obligation by causing the organization to commit an act that, if committed by the State, would have constituted a breach of the obligation.
۲. Paragraph ۱ applies whether or not the act in question is internationally wrongful for the international organization.
