۱۳ موافقت‌نامه مراکش تأسیس سازمان تجارت جهانی

۲- تنها در مواردی می‌توان در روابط میان اعضای اصلی سازمان جهانی تجارت که طرف متعاهد گات ۱۹۴۷ بودند، به بند ۱ متوسل شد که پیشتر به ماده ۳۵ این موافقت‌نامه(گات ۱۹۴۷) استناد شده و ماده مزبور در زمان لازم‌الاجرا شدن این موافقت‌نامه برای طرف‌های متعاهد، میان آن‌ها نافذ باشد.

۳- تنها در صورتی بند ۱ میان یک عضو و عضو دیگری که طبق ماده ۱۲ ملحق شده است قابل اجرا خواهد بود که عضو مخالف با اجرا، قبل از تصویب توافق راجع‌به شرایط الحاق توسط کنفرانس وزیران، مراتب را به کنفرانس وزیران اطلاع داده باشد.

۴- کنفرانس وزیران می‌تواند بنا به درخواست هر عضو اجرای این ماده را در موارد خاص بررسی کند و توصیه‌های مقتضی را به عمل آورد.

۵- عدم اجرای یک موافقت‌نامه تجاری میان چند طرف [بدون الزام عضویت همه اعضای گات] میان طرف‌های آن موافقت‌نامه، مشمول مقررات آن موافقت‌نامه خواهد بود.

۱.This Agreement and the Multilateral Trade Agreements in Annexes ۱ and ۲ shall not apply as between any Member and any other Member if either of the Members, at the time either becomes a Member, does not consent to such application.

۲.Paragraph ۱ may be invoked between original Members of the WTO which were contracting parties to GATT ۱۹۴۷ only where Article XXXV of that Agreement had been invoked earlier and was effective as between those contracting parties at the time of entry into force for them of this Agreement.

۳.Paragraph ۱ shall apply between a Member and another Member which has acceded under Article XII only if the Member not consenting to the application has so notified the Ministerial Conference before the approval of the agreement on the terms of accession by the Ministerial Conference.

۴.The Ministerial Conference may review the operation of this Article in particular cases at the request of any Member and make appropriate recommendations.

۵.Non-application of a Plurilateral Trade Agreement between parties to that Agreement shall be governed by the provisions of that Agreement.
