۱- تصمیمات، رویه‌ها و عملکرد عرفی طرف‌های متعاهد گات ۱۹۴۷ و ارکان تشکیل شده در چارچوب گات ۱۹۴۷ راهنمای سازمان جهانی تجارت خواهند بود، مگر اینکه در موافقت‌نامه حاضر یا موافقت‌نامه‌های تجاری چند‌جانبه به ترتیب دیگری مقرر شده باشد.
۲- تا آنجا که عملی باشد، دبیرخانه گات ۱۹۴۷ به دبیرخانه سازمان جهانی تجارت تبدیل خواهد شد و تا زمانی که کنفرانس وزیران مدیر کلی را طبق بند ۲ ماده ۶ موافقت‌نامه حاضر منصوب کند، مدیر کل طرف‌های متعاهد گات۱۹۴۷ به عنوان مدیر کل سازمان جهانی تجارت خدمت خواهد کرد.
۳- در صورت تعارض میان مقرره‌ای در موافقت‌نامه حاضر و مقرره‌ای در هریک از موافقت‌نامه‌های تجاری چند‌جانبه، مقرره موافقت‌نامه حاضر، در محدوده‌ای که تعارض وجود دارد، مقدم خواهد بود.
۴- هر عضو انطباق قوانین، آیین‌نامه‌ها و رویه‌های اداری خود با تعهداتش به نحو مقرر در موافقت‌نامه‌های ضمیمه را تضمین خواهد کرد.
۵- نمی‌توان در مورد هیچ مقرره‌ای در موافقت‌نامه حاضر قید و شرط قائل شد. قید و شرط در خصوص هریک از مقررات موافقت‌نامه‌های تجاری چند جانبه تنها می‌تواند در حد پیش‌بینی شده در این موافقت‌نامه‌ها باشد. قید و شرط در خصوص یک موافقت‌نامه تجاری میان چند طرف [بدون الزام عضویت همه اعضای گات] مشمول مقررات آن موافقت‌نامه خواهد بود.
۶- موافقت‌نامه حاضر طبق مقررات ماده ۱۰۲ منشور ملل متحد ثبت خواهد شد.
منعقده در مراکش به تاریخ پانزدهم آوریل هزار و نهصد و نود و چهار، در نسخه‌ای واحد به زبان‌های انگلیسی، فرانسوی و اسپانیایی که هریک از این متون معتبر است.
یادداشت‌های توضیحی:
در موافقت‌نامه حاضر و موافقت‌نامه‌های تجاری چند جانبه واژه‌های «کشور» یا کشورها ضمناً هرگونه قلمروی گمرکی مجزای عضو سازمان جهانی تجارت را شامل می‌شود.
در خصوص یک قلمروی گمرکی مجزای عضو سازمان جهانی تجارت اگر عبارتی در موافقت‌نامه حاضر و موافقت‌نامه‌های تجاری چند جانبه مقید به کلمه «ملی» باشد، چنین عبارتی باید در ارتباط با آن قلمروی گمرکی در نظر گرفته شود، مگر اینکه به ترتیب دیگری مشخص شده باشد.
۱.Except as otherwise provided under this Agreement or the Multilateral Trade Agreements, the WTO shall be guided by the decisions, procedures and customary practices followed by the CONTRACTING PARTIES to GATT ۱۹۴۷ and the bodies established in the framework of GATT ۱۹۴۷.
۲.To the extent practicable, the Secretariat of GATT ۱۹۴۷ shall become the Secretariat of the WTO, and the Director-General to the CONTRACTING PARTIES to GATT ۱۹۴۷, until such time as the Ministerial Conference has appointed a Director-General in accordance with paragraph ۲ of Article VI of this Agreement, shall serve as Director-General of the WTO.
۳.In the event of a conflict between a provision of this Agreement and a provision of any of the Multilateral Trade Agreements, the provision of this Agreement shall prevail to the extent of the conflict.
۴.Each Member shall ensure the conformity of its laws, regulations and administrative procedures with its obligations as provided in the annexed Agreements.
۵.No reservations may be made in respect of any provision of this Agreement. Reservations in respect of any of the provisions of the Multilateral Trade Agreements may only be made to the extent provided for in those Agreements. Reservations in respect of a provision of a Plurilateral Trade Agreement shall be governed by the provisions of that Agreement.
۶.This Agreement shall be registered in accordance with the provisions of Article ۱۰۲ of the Charter of the United Nations.
DONE at Marrakesh this fifteenth day of April one thousand nine hundred and ninety-four, in a single copy, in the English, French and Spanish languages, each text being authentic.
Explanatory Notes
The terms "country" or "countries" as used in this Agreement and the Multilateral Trade Agreements are to be understood to include any separate customs territory Member of the WTO.
In the case of a separate customs territory Member of the WTO, where an expression in this Agreement and the Multilateral Trade Agreements is qualified by the term "national", such expression shall be read as pertaining to that customs territory, unless otherwise specified.
