۱. دعاوی به اقتضای مورد یا به وسیله ابلاغ توافق طرفین دعوی یا به وسیله دادخواستی که به دفتردار داده میشود به دیوان رجوع میگردد. در هر صورت باید موضوع اختلاف و طرفین دعوی معین گردند.
۲. دفتردار فوراً عرض حال را به هر ذینفعی ابلاغ میکند.
۳. و نیز نامبرده موضوع را به وسیله دبیر کل سازمان ملل متحد به اطلاع اعضای ملل متحد و همچنین به اطلاع دولتهایی که حق رجوع به دیوان دارند میرساند.
۱. Cases are brought before the Court, as the case may be, either by the notification of the special agreement or by a written application addressed to the Registrar. In either case the subject of the dispute and the parties shall be indicated.
۲. The Registrar shall forthwith communicate the application to all concerned.
۳. He shall also notify the Members of the United Nations through the Secretary-General, and also any other states entitled to appear before the Court.
