۱. علیرغم مفاد بند (۱) ماده یازدهم، هر طرف متعاهد به منظور حفظ وضعیت مالی خارجی و تراز پرداختهای خود میتواند مقدار یا ارزش کالای مجاز برای واردات را با رعایت مفاد بندهای زیر این ماده محدود کند.
۲. الف) محدودیتهای وارداتی که توسط یک طرف متعاهد به موجب این ماده ایجاد، حفظ یا تشدید میشود، نباید از موارد ضروری تجاوز کند: (۱) برای جلوگیری از تهدید قریبالوقوع یا متوقف کردن کاهش جدی ذخایر پولی خود، یا (۲) در مورد یک طرف متعاهد با ذخایر پولی بسیار پایین، برای دستیابی به نرخ معقولی افزایش ذخایر خود. در هر صورت باید به عوامل خاصی که ممکن است بر ذخایر آن طرف متعاهد یا نیاز آن به ذخایر تأثیر بگذارد، توجه لازم مبذول خواهد شد، از جمله، در مواردی که اعتبارات خارجی خاص یا سایر منابع در دسترس آن باشد، نیاز به تأمین استفاده مناسب از این اعتبارات یا منابع.
ب) طرفهای متعاهدی که محدودیتهایی را تحت بند (الف) این بند اعمال میکنند، با بهبود شرایط، آنها را به تدریج کاهش میدهند و فقط تا حدی حفظ میکنند که شرایط مشخصشده در آن جزء فرعی همچنان اعمال آنها را توجیه کند. زمانی که شرایط دیگر مؤسسه یا نگهداری آنها را طبق آن بند فرعی توجیه نمی کند، آنها باید محدودیت ها را حذف کنند.
۳. الف) طرفهای متعاهد متعهد میشوند که در اجرای سیاستهای داخلی خود، به نیاز به حفظ یا بازگرداندن تعادل در تراز پرداختهای خود بر مبنایی سالم و پایدار و مطلوبیت اجتناب از استفاده غیراقتصادی منابع تولیدی توجه لازم را داشته باشند. آنها تشخیص می دهند که برای دستیابی به این اهداف، تا آنجا که ممکن است، مطلوب است که اقداماتی اتخاذ شود که به جای کاهش تجارت بین المللی، گسترش یابد.
ب) طرفهای متعاهدی که محدودیتهایی را طبق این ماده اعمال میکنند، میتوانند میزان بروز محدودیتها را بر واردات محصولات یا کلاسهای مختلف محصولات به گونهای تعیین کنند که واردات آن محصولاتی را که ضروریتر هستند، اولویت دهند.
ج) طرفهای متعاهدی که محدودیتهایی را به موجب این ماده اعمال میکنند متعهد میشوند: (۱) از آسیب غیرضروری به منافع تجاری یا اقتصادی هر طرف متعاهد دیگر جلوگیری کنند. (۲) عدم اعمال محدودیتها بهمنظور جلوگیری از واردات غیرمنطقی هر گونه توصیف کالایی در حداقل مقادیر تجاری که استثناء آن به کانالهای منظم تجارت لطمه میزند. و (iii) محدودیتهایی را اعمال نکند که از واردات نمونههای تجاری جلوگیری میکند یا از انطباق با ثبت اختراع، علامت تجاری، حق چاپ یا رویههای مشابه جلوگیری میکند. (د) طرفهای متعاهد تشخیص می دهند که در نتیجه سیاست های داخلی در جهت دستیابی و با حفظ اشتغال کامل و مولد یا در جهت توسعه منابع اقتصادی، یک طرف متعاهد ممکن است تقاضای بالایی برای واردات داشته باشد که تهدیدی برای ذخایر پولی وی از نوع مذکور در بند ۲ (الف) این ماده باشد. بر این اساس، طرف متعاهدی که در غیر این صورت مفاد این ماده را رعایت میکند، ملزم به لغو یا تعدیل محدودیتها به این دلیل نیست که تغییر در آن سیاستها باعث ایجاد محدودیتهای غیرضروری میشود که طبق این ماده اعمال میکند.
۴. الف) هر طرف متعاهدی که محدودیتهای جدید اعمال میکند یا سطح کلی محدودیتهای موجود خود را با تشدید قابلتوجه اقدامات اعمالشده بر اساس این ماده افزایش میدهد، بلافاصله پس از ایجاد یا تشدید چنین محدودیتهایی (یا در شرایطی که مشاوره قبلی عملی است، قبل از انجام آن) با طرفهای متعاهد مشورت خواهد کرد که ممکن است از نظر ماهیت پرداخت صحیح، اقدامات جایگزین ممکن است مشکل باشد. تأثیر محدودیت ها بر اقتصاد سایر طرف های متعاهد. (ب) در تاریخی که توسط آنها تعیین می شود، طرفهای متعاهد باید تمام محدودیت هایی را که همچنان در آن تاریخ تحت این ماده اعمال می شود، بررسی کنند. از یک سال پس از آن تاریخ، طرفهای متعاهدی که محدودیتهای واردات را به موجب این ماده اعمال میکنند، باید سالانه با طرفهای متعاهد از نوع پیشبینیشده در بند (الف) این بند مشورت کنند.
ج) (i) اگر در جریان مشاوره با یکی از طرفهای متعاهد طبق بند (الف) یا (ب) فوق، طرفین متعاهد متوجه شوند که محدودیتها با مفاد این ماده یا با مفاد ماده سیزدهم (با رعایت مفاد ماده چهاردهم) مطابقت ندارد، باید ماهیت ناهماهنگی را مشخص کرده و ممکن است توصیه کنند. (دوم) اگر در نتیجه مشورتها، طرفهای متعاهد تشخیص دهند که محدودیتها به نحوی اعمال میشوند که مستلزم مغایرت شدید ماهیت با مفاد این ماده یا با مفاد ماده سیزدهم (با رعایت مفاد ماده چهاردهم) باشد و خسارت به تجارت هر طرف متعاهدی در اثر اطلاعرسانی طرف متعاهد ایجاد شده یا تهدید شود، باید آن را اعمال کنند. توصیه های مناسب برای تضمین انطباق با این مقررات در یک دوره زمانی مشخص. در صورتی که این طرف متعاهد از این توصیهها در مدت تعیینشده پیروی نکند، طرفهای متعاهد میتوانند هر طرف متعاهدی را که تجارت آن تحت تأثیر محدودیتها قرار گرفته است را از چنین تعهداتی به موجب این موافقتنامه نسبت به طرف متعاهدی که محدودیتها را اعمال میکند، آزاد کنند. تعیین کنید که در شرایط مناسب باشد.
د) طرفهای متعاهد از هر طرف متعاهدی که محدودیتهایی را طبق این ماده اعمال میکند دعوت میکنند تا بنا به درخواست هر طرف متعاهدی که میتواند در ابتدا ثابت کند که محدودیتها با مفاد این ماده یا با مقررات ماده سیزدهم (با رعایت مفاد ماده چهاردهم) مغایرت دارد و تجارت آن بر خلاف آن اثر میگذارد، با آنها مشورت کند. با این حال، هیچ دعوتنامه ای صادر نمی شود مگر اینکه طرف های متعاهد اطمینان حاصل کنند که گفتگوهای مستقیم بین طرف های متعاهد مربوطه موفقیت آمیز نبوده است. چنانچه در نتیجه مشورت با طرفهای متعاهد، توافق حاصل نشود و آنها تشخیص دهند که محدودیتها مغایر با این مقررات اعمال میشود و از این طریق خسارتی به تجارت طرف متعاهد آغازکننده رویه وارد شده یا تهدید میشود، لغو یا تعدیل محدودیتها را توصیه میکنند. اگر محدودیتها در مدت زمانی که طرفهای متعاهد مقرر میکنند لغو یا اصلاح نشوند، میتوانند طرف متعاهدی را که رویه را آغاز میکند از چنین تعهداتی به موجب این موافقتنامه در قبال طرف متعاهدی که محدودیتها را مطابق با شرایط مناسب تشخیص میدهند، رها کنند. (ه) در اقدام بر اساس این بند، طرفهای متعاهد باید به هر عامل خارجی خاصی که بر تجارت صادراتی طرف متعاهد اعمال کننده محدودیت ها تأثیر منفی بگذارد توجه لازم را داشته باشند.
و) تصمیمات مندرج در این بند باید به سرعت و در صورت امکان ظرف شصت روز پس از شروع مشاوره انجام شود.
۵. در صورت اعمال مداوم و گسترده محدودیتهای واردات بر اساس این ماده، که نشان دهنده وجود یک عدم تعادل عمومی است که تجارت بینالمللی را محدود میکند، طرفهای متعاهد باید بحثهایی را برای بررسی اینکه آیا ممکن است اقدامات دیگری اتخاذ شود، چه توسط آن طرفهای متعاهدی که تراز پرداختهای آنها تحت فشار است یا از سوی آنهایی که تراز پرداختها بهطور مناسبی ممکن است انجام شود یا بهخاطر مواردی که تراز پرداختها مستثنی هستند، انجام شود. سازمان بین دولتی، برای حذف علل زمینه ای عدم تعادل. به دعوت طرفهای متعاهد، طرفهای متعاهد در این بحثها شرکت خواهند کرد.
۲. (a) Import restrictions instituted, maintained or intensified by a contracting party under this Article shall not exceed those necessary:
(i) to forestall the imminent threat of, or to stop, a serious decline in its monetary reserves, or
(ii) in the case of a contracting party with very low monetary reserves, to achieve a reasonable rate of increase in its reserves.
Due regard shall be paid in either case to any special factors which may be affecting the reserves of such contracting party or its need for reserves, including, where special external credits or other resources are available to it, the need to provide for the appropriate use of such credits or resources.
(b) Contracting parties applying restrictions under subparagraph (a) of this paragraph shall progressively relax them as such conditions improve, maintaining them only to the extent that the conditions specified in that sub-paragraph still justify their application. They shall eliminate the restrictions when conditions would no longer justify their institution or maintenance under that sub-paragraph.
۳. (a) Contracting parties undertake, in carrying out their domestic policies, to pay due regard to the need for maintaining or restoring equilibrium in their balance of payments on a sound and lasting basis and to the desirability of avoiding an uneconomic employment of productive resources. They recognize that, in order to achieve these ends, it is desirable so far as possible to adopt measures which expand rather than contract international trade.
(b) Contracting parties applying restrictions under this Article may determine the incidence of the restrictions on imports of different products or classes of products in such a way as to give priority to the importation of those products which are more essential.
(c) Contracting parties applying restrictions under this Article undertake:
(i) to avoid unnecessary damage to the commercial or economic interests of any other contracting party;
(ii) not to apply restrictions so as to prevent unreasonably the importation of any description of goods in minimum commercial quantities the exclusion of which would impair regular channels of trade; and
(iii) not to apply restrictions which would prevent the importations of commercial samples or prevent compliance with patent, trade mark, copyright, or similar procedures.
(d) The contracting parties recognize that, as a result of domestic policies directed towards the achievement and maintenance of full and productive employment or towards the development of economic resources, a contracting party may experience a high level of demand for imports involving a threat to its monetary reserves of the sort referred to in paragraph ۲ (a) of this Article. Accordingly, a contracting party otherwise complying with the provisions of this Article shall not be required to withdraw or modify restrictions on the ground that a change in those policies would render unnecessary restrictions which it is applying under this Article.
۴. (a) Any contracting party applying new restrictions or raising the general level of its existing restrictions by a substantial intensification of the measures applied under this Article shall immediately after instituting or intensifying such restrictions (or, in circumstances in which prior consultation is practicable, before doing so) consult with the CONTRACTING PARTIES PARTIES as to the nature of its balance of payments difficulties, alternative corrective measures which may be available, and the possible effect of the restrictions on the economies of other contracting parties.
(b) On a date to be determined by them, the CONTRACTING PARTIES PARTIES shall review all restrictions still applied under this Article on that date. Beginning one year after that date, contracting parties applying import restrictions under this Article shall enter into consultations of the type provided for in sub-paragraph (a) of this paragraph with the CONTRACTING PARTIES PARTIES annually.
(c) (i) If, in the course of consultations with a contracting party under sub-paragraph (a) or (b) above, the CONTRACTING PARTIES PARTIES find that the restrictions are not consistent with provisions of this Article or with those of Article XIII (subject to the provisions of Article XIV), they shall indicate the nature of the inconsistency and may advise that the restrictions be suitably modified.
(ii) If, however, as a result of the consultations, the CONTRACTING PARTIES PARTIES determine that the restrictions are being applied in a manner involving an inconsistency of a serious nature with the provisions of this Article or with those of Article XIII (subject to the provisions of Article XIV) and that damage to the trade of any contracting party is caused or threatened thereby, they shall so inform the contracting party applying the restrictions and shall make appropriate recommendations for securing conformity with such provisions within a specified period of time. If such contracting party does not comply with these recommendations within the specified period, the CONTRACTING PARTIES PARTIES may release any contracting party the trade of which is adversely affected by the restrictions from such obligations under this Agreement towards the contracting party applying the restrictions as they determine to be appropriate in the circumstances.
(d) The CONTRACTING PARTIES PARTIES shall invite any contracting party which is applying restrictions under this Article to enter into consultations with them at the request of any contracting party which can establish a prima facie case that the restrictions are inconsistent with the provisions of this Article or with those of Article XIII (subject to the provisions of Article XIV) and that its trade is adversely affected thereby. However, no such invitation shall be issued unless the CONTRACTING PARTIES PARTIES have ascertained that direct discussions between the contracting parties concerned have not been succes sfai. If, as a result of the consultations with the CONTRACTING PARTIES PARTIES, no agreement is reached and they determine that the restrictions are being applied inconsistently with such provisions, and that damage to the trade of the contracting party initiating the procedure is caused or threatened thereby, they shall recommend the withdrawal or modification of the restrictions. If the restrictions are not withdrawn or modified within such time as the CONTRACTING PARTIES PARTIES may prescribe, they may release the contracting party initiating the procedure from such obligations under this Agreement towards the contracting party applying the restrictions as they determine to be appropriate in the circumstances.
(e) In proceeding under this paragraph, the CONTRACTING PARTIES PARTIES shall have due regard to any special external factors adversely affecting the export trade of the contracting party applying the restrictions.
(f) Determinations under this paragraph shall be rendered expeditiously and, if possible, within sixty days of the initiation of the consultations.
