۳۹ موافقت‌نامه 1947عمومی تعرفه و تجارت (GATT)

۳۹ - Article XXXVIII — Joint Action - ماده ۳۸ — اقدام مشترک

۱. طرفهای متعاهد در چارچوب این موافقتنامه و در جاهای دیگر، در صورت لزوم، برای پیشبرد اهداف مندرج در ماده XXXVI، مشترکاً همکاری خواهند کرد.

۲. به ویژه، طرفهای متعاهد: (الف) در صورت لزوم، از جمله اقداماتی از طریق ترتیبات بین‌المللی، برای فراهم کردن شرایط بهبودیافته و قابل قبول دسترسی به بازارهای جهانی برای محصولات اولیه با منافع خاص برای طرف‌های کمتر توسعه‌یافته و تدبیر تدابیر طراحی شده برای تثبیت و بهبود شرایط بازارهای جهانی در این محصولات، از جمله اقدامات طراحی شده برای دستیابی به قیمت‌های پایدار و منصفانه برای چنین محصولاتی با ثبات و منصفانه.

ب) به دنبال همکاری مناسب در زمینه سیاست تجارت و توسعه با سازمان ملل متحد و ارگان ها و آژانس های آن، از جمله هر نهادی که ممکن است بر اساس توصیه های کنفرانس تجارت و توسعه سازمان ملل متحد ایجاد شود.

ج) در تحلیل برنامه‌ها و سیاست‌های توسعه تک‌تک طرف‌های متعاهد کمتر توسعه‌یافته و در بررسی روابط تجاری و کمک‌رسانی به منظور ابداع تدابیر مشخص برای ارتقای توسعه پتانسیل صادراتی و تسهیل دسترسی به بازارهای صادراتی محصولات صنایعی که بدین ترتیب توسعه یافته‌اند، همکاری می‌کنند و در این رابطه، به دنبال همکاری مجدد مناسب با دولت‌ها و سازمان‌های بین‌المللی خاص هستند. توسعه اقتصادی، در مطالعات نظام‌مند روابط تجاری و کمک‌ها در طرف‌های متعاهد کمتر توسعه‌یافته، با هدف دستیابی به تحلیل واضحی از پتانسیل صادرات، چشم‌انداز بازار و هر اقدام دیگری که ممکن است مورد نیاز باشد. (د) توسعه تجارت جهانی را با توجه ویژه به نرخ رشد تجارت طرف‌های کمتر توسعه‌یافته تحت بازبینی مستمر قرار دهد و در شرایطی که مناسب تشخیص داده شود، توصیه‌هایی را به طرف‌های متعاهد ارائه کند.

نظر گرفته شده است. تجارت تمام سرزمین هایی که موافقت نامه عمومی تعرفه ها و تجارت در مورد آنها اعمال می شود را در نظر بگیرید. ضمیمه ۱ یادداشت ها و مقررات تکمیلی و بند ۱ ماده ۱ تعهدات گنجانده شده در بند ۱ ماده ۱ با ارجاع به بندهای ۲ و ۴ ماده ۳ و تعهداتی که در بند ۲ (ب) ماده ۲ با ارجاع به ماده VI با ارجاع به ماده ۶ گنجانده شده است، به منظور مقاصد پروتکل‌نامه مشمول قسمت دوم تلقی می‌شوند. ارجاعات متقابل، در بند بلافاصله بالا و در بند ۱ ماده ۱، به بندهای ۲ و ۴ ماده ۳ فقط پس از اصلاح ماده III با لازم الاجرا شدن اصلاحیه مقرر در پروتکل اصلاح کننده قسمت دوم و ماده XXVI موافقتنامه عمومی تعرفه ها و تجارت مورخ ۱۴ سپتامبر ۱۹۴۸ اعمال می شود. نرخ عوارض کشور برتر و نرخ ترجیحی عوارض برای کالای مشابه، و نه رابطه متناسب بین این نرخ‌ها. به عنوان مثال: ۱.) اگر نرخ مطلوب ترین کشور ۳۶ درصد ارزشی و نرخ ترجیحی ۲۴ درصد بر ارزشی بود، حاشیه ترجیح ۱۲ درصد بر ارزشی خواهد بود و نه یک سوم نرخ مطلوب ترین کشور. ۲) نرخ مطلوب ترین کشور ۳۶ درصد بر ارزشی بود و نرخ ترجیحی به عنوان دو سوم نرخ مطلوب ترین کشور بیان شد، حاشیه ترجیح ۱۲ درصد ارزشی خواهد بود. ۳.) نرخ مطلوب ترین کشور ۲ فرانک در هر کیلوگرم و نرخ ترجیحی ۱.۵۰ فرانک در هر کیلوگرم بود، حاشیه ترجیح ۰.۵۰ فرانک در هر کیلوگرم بود. انواع اقدامات گمرکی زیر که طبق رویه‌های یکسان تعیین شده انجام می‌شود، مغایر با الزام عمومی حاشیه‌های ترجیحی نخواهد بود: اعمال مجدد طبقه‌بندی تعرفه‌ای یا نرخ عوارض گمرکی برای کالای وارداتی که به درستی برای آن کالا اعمال می‌شود، در مواردی که اعمال چنین طبقه‌بندی یا نرخی برای آن محصول به طور موقت به حالت تعلیق درآمده یا در تاریخ ۱۹ آوریل ۱۷۱۰ غیرفعال شده است. و طبقه بندی یک محصول خاص تحت یک اقلام تعرفه ای غیر از آنچه که واردات آن محصول در ۱۰ آوریل ۱۹۴۷ تحت آن طبقه بندی شده است، در مواردی که قانون تعرفه به وضوح در نظر دارد که چنین کالایی ممکن است تحت بیش از یک آیتم تعرفه طبقه بندی شده است. بند ۲ ماده ۲ الف) ارجاع متقابل بند ۲ (الف) ماده II به بند ۲ ماده ۳ فقط پس از اصلاح ماده III با لازم‌الاجرا شدن اصلاحیه مقرر در پروتکل اصلاح بخش II و ماده XXVI موافقت‌نامه عمومی تعرفه‌ها و تجارت مورخ ۱۴ سپتامبر ۱۹۴۸ از بند ۲۱ به بند ۲۱ ب اعمال می‌شود. ماده ۱. بند ۴ به استثنای مواردی که بطور خاص بین طرفهای متعاهدی که در ابتدا در مورد امتیاز مذاکره کرده اند توافق شده باشد، مفاد این بند در پرتو مفاد ماده ۳۱ منشور هاوانا اعمال خواهد شد. ماده ۳ هر گونه مالیات داخلی یا سایر هزینه های داخلی، یا هر قانون، مقررات یا الزامی از نوع مذکور در بند ۱ که در مورد کالای وارداتی و کالای داخلی مشابه اعمال می شود و در مورد کالای وارداتی در زمان یا نقطه واردات اخذ یا اجرا می شود، با این وجود به عنوان مالیات داخلی یا سایر هزینه های داخلی، یا قانون، مقررات یا الزامات مربوط به بند ۱ تلقی می شود. مقاله III. بند ۱ اعمال بند ۱ بر مالیات های داخلی تحمیل شده توسط دولت ها و مقامات محلی در قلمرو یک طرف متعاهد مشمول مقررات بند پایانی ماده بیست و چهارم می باشد. اصطلاح «اقدامات معقول» در پاراگراف آخر، برای مثال، ملغی به لغو قوانین ملی موجود که به دولت‌های محلی اجازه وضع مالیات‌های داخلی را می‌دهد که اگر چه از نظر فنی با مفاد ماده ۳ مغایرت ندارد، در واقع با روح آن مغایرت ندارد، در صورتی که چنین لغوی منجر به مشکلات مالی جدی برای دولت‌ها یا مقامات محلی مربوطه شود. با توجه به مالیات دولت‌ها یا مقامات محلی که با متن و روح ماده ۳ مغایرت دارد، اصطلاح «اقدامات معقول» به طرف قرارداد اجازه می‌دهد تا مالیات ناسازگار را به تدریج در یک دوره انتقال حذف کند، در صورتی که اقدام ناگهانی مشکلات اداری و مالی جدی ایجاد کند. بند ۲ مالیاتی که با الزامات جمله اول بند ۲ مطابقت داشته باشد تنها در مواردی که رقابت بین محصول مشمول مالیات و از طرف دیگر کالای مستقیم رقابتی یا قابل جایگزینی که به طور مشابه مشمول مالیات نبوده است، مغایر با مقررات جمله دوم تلقی می شود. بند ۵ مقررات منطبق با مفاد جمله اول بند ۵ در هیچ موردی که کلیه محصولات مشمول مقررات در داخل کشور در مقادیر قابل توجهی تولید می شود. یک مقررات را نمی توان به دلیل اینکه نسبت یا مقدار تخصیص به هر یک از محصولات موضوع مقررات، رابطه عادلانه ای بین محصولات وارداتی و داخلی ایجاد می کند، مطابق با مفاد جمله دوم توجیه کرد. بند ۵ ماده ۵ در رابطه با هزینه های حمل و نقل، اصل مقرر در بند ۵ به حمل محصولات مشابه در یک مسیر در شرایط مشابه اشاره دارد. آگهی ماده ششم بند ۱ ۱. دامپینگ پنهان توسط خانه‌های مرتبط (یعنی فروش توسط واردکننده به قیمتی کمتر از قیمتی که صادرکننده با واردکننده با آن در ارتباط است، و همچنین کمتر از قیمت در کشور صادرکننده) نوعی دامپینگ قیمتی است که با توجه به آن، حاشیه دامپینگ می‌تواند بر اساس قیمت کالای وارداتی مجدد محاسبه شود.

۲. تشخیص داده می شود که در مورد واردات از کشوری که انحصار کامل یا اساساً کامل تجارت خود را دارد و همه قیمت های داخلی توسط دولت تعیین می شود، ممکن است مشکلات ویژه ای در تعیین قابلیت مقایسه قیمت برای اهداف بند ۱ وجود داشته باشد و در چنین مواردی ممکن است طرف های متعاهد واردکننده لازم بدانند که این احتمال را که ممکن است چنین مقایسه دقیقی با قیمت های داخلی همیشه مناسب نباشد، در نظر بگیرند. بندهای ۲ و ۳ ۱. مانند بسیاری از موارد دیگر در گمرکات، یک طرف قرارداد ممکن است برای پرداخت حقوق ضد دامپینگ یا تعرفه جبرانی، تا زمان تعیین نهایی واقعیات در هر مورد مشکوک به دامپینگ یا یارانه، وثیقه معقولی (اوراق قرضه یا سپرده نقدی) را درخواست کند. ۲- رویه‌های ارزی چندگانه در شرایط خاصی می‌تواند یارانه‌ای برای صادرات باشد که ممکن است با عوارض جبرانی طبق بند ۳ تأمین شود یا می‌تواند نوعی دامپینگ از طریق کاهش بخشی از ارزش پول یک کشور باشد که ممکن است با اقدام طبق بند ۲ برآورده شود. منظور از «روش‌های چند ارزی»، رویه‌هایی است که توسط دولت‌ها یا دولت‌ها انجام می‌شود. بند ۶ (ب) معافیت ها بر اساس مفاد این بند فرعی فقط در صورت درخواست طرف متعاهدی که پیشنهاد وضع عوارض ضد دامپینگ یا جبرانی را دارد، حسب مورد اعطا خواهد شد. بند ۱ ماده هفتم عبارت «یا سایر هزینه‌ها» شامل مالیات‌های داخلی یا هزینه‌های معادل آن نیست که بر یا در ارتباط با محصولات وارداتی اعمال می‌شود. بند ۲ ۱. این مطابق با ماده ۷ خواهد بود که فرض کنیم «ارزش واقعی» را می‌توان با قیمت صورت‌حساب، به اضافه هرگونه هزینه‌های غیرشامل‌شده برای هزینه‌های قانونی که عناصر مناسب «ارزش واقعی» هستند و هر گونه تخفیف غیرعادی نشان داد. یا کاهش دیگر از قیمت رقابتی معمولی.

۲. مطابق با بند ۲ (ب) ماده هفت خواهد بود که طرف متعاهد عبارت "در جریان عادی تجارت ... تحت شرایط کاملاً رقابتی" را به عنوان استثناء هرگونه معامله ای که در آن خریدار و فروشنده مستقل از یکدیگر نیستند و قیمت تنها مورد توجه قرار نمی گیرد، تفسیر کند.

۳. استاندارد «شرایط کاملاً رقابتی» به طرف قرارداد اجازه می‌دهد تا قیمت‌هایی را که شامل تخفیف‌های ویژه محدود به نمایندگان انحصاری می‌شود را از در نظر گرفتن مستثنی کند.

۴. عبارت زیر بندهای (الف) و (ب) به یک طرف قرارداد اجازه می دهد تا ارزش گمرکی را به طور یکسان تعیین کند یا (۱) بر اساس قیمت های صادرکننده خاص کالاهای وارداتی یا (۲) بر اساس سطح عمومی قیمت کالاهای مشابه. ماده هشتم ۱. در حالی که ماده هشتم استفاده از چند نرخ ارز را پوشش نمی دهد، بندهای ۱ و ۴ استفاده از مالیات یا کارمزد مبادلات را به عنوان ابزاری برای اجرای چندین روش ارزی محکوم می کند. با این حال، اگر یک طرف قرارداد با تأیید صندوق بین‌المللی پول از کارمزدهای مبادله ارز چندگانه برای تراز پرداخت‌ها استفاده می‌کند، مفاد بند ۹ (الف) ماده پانزدهم کاملاً از موقعیت آن محافظت می‌کند.

۲. اگر در واردات محصولات از قلمرو یک طرف متعاهد به قلمرو طرف متعاهد دیگر، ارائه گواهی مبدأ فقط تا حدی الزامی شود که کاملاً ضروری است، با بند ۱ مطابقت دارد. مقالات آگهی XI، XII، XIII، XIV و XVIII در سراسر مواد XI، XII، XIII، XIV و XVIII اصطلاحات «محدودیت‌های وارداتی» یا «محدودیت‌های صادراتی» شامل محدودیت‌هایی است که از طریق عملیات تجاری دولتی اعمال می‌شوند. ماده یازدهم بند ۲ (ج) عبارت «به هر شکلی» در این بند شامل همان محصولاتی می شود که در مراحل اولیه فرآوری هستند و هنوز فاسد شدنی هستند که مستقیماً با محصول تازه رقابت می کنند و اگر آزادانه وارد شوند، محدودیت در محصول تازه را بی اثر می کنند. بند ۲، بند آخر عبارت «عوامل ویژه» شامل تغییرات در بازده نسبی تولیدی بین تولیدکنندگان داخلی و خارجی، یا بین تولیدکنندگان مختلف خارجی است، اما تغییراتی که به طور مصنوعی از طریق وسایلی که طبق موافقتنامه مجاز نیستند، ایجاد شود. در ماده دوازدهم، طرفهای متعاهد در انجام هرگونه مشاوره طبق مفاد این ماده، حداکثر محرمانه بودن را پیش بینی خواهند کرد. بند ۳ (ج) (i) طرف‌های متعاهدی که محدودیت‌ها را اعمال می‌کنند باید تلاش کنند از وارد کردن آسیب جدی به صادرات کالایی که اقتصاد یک طرف متعاهد عمدتاً به آن وابسته است، جلوگیری کنند. بند ۴ (ب) توافق شده است که تاریخ باید ظرف نود روز پس از لازم‌الاجرا شدن اصلاحات این ماده که توسط پروتکل اصلاح مقدمه و قسمت‌های دوم و سوم این موافقتنامه اعمال شده است. با این حال، اگر طرفهای متعاهد تشخیص دهند که شرایط برای اجرای مفاد این بند فرعی در زمان مورد نظر مناسب نبوده است، می توانند تاریخ بعدی را تعیین کنند. مشروط بر اینکه این تاریخ بیش از سی روز پس از زمانی که تعهدات ماده هشتم، بخش‌های ۲، ۳ و ۴ مواد موافقت‌نامه صندوق بین‌المللی پول برای طرف‌های متعاهد، اعضای صندوق، که مجموع تجارت خارجی آنها حداقل پنجاه درصد کل تجارت خارجی همه طرف‌های متعاهد را تشکیل می‌دهد، اعمال شود، بیش از سی روز نباشد. بند ۴ (ه) توافق شده است که بند ۴ (ه) هیچ معیار جدیدی برای اعمال یا حفظ محدودیت‌های کمی به دلایل تراز پرداخت‌ها اضافه نمی‌کند. صرفاً به این منظور است که اطمینان حاصل شود که تمام عوامل خارجی مانند تغییرات در شرایط تجارت، محدودیت‌های کمی، تعرفه‌های بیش از حد و یارانه‌ها که ممکن است به مشکلات تراز پرداخت‌های طرف متعاهد اعمال کننده محدودیت کمک کند، به طور کامل در نظر گرفته شود. در ماده سیزدهم بند ۲ (د) هیچ اشاره ای به "ملاحظات تجاری" به عنوان قاعده ای برای تخصیص سهمیه ها نشده است زیرا در نظر گرفته شد که اعمال آن توسط مقامات دولتی ممکن است همیشه عملی نباشد. علاوه بر این، در مواردی که عملی باشد، یک طرف متعاهد می‌تواند این ملاحظات را در فرآیند درخواست توافق، مطابق با قاعده کلی مندرج در جمله آغازین بند ۲ اعمال کند. بند ۱ ماده چهاردهم مفاد این بند نباید به گونه‌ای تفسیر شود که طرف‌های متعاهد را در مشاوره‌های مقرر در بند ۴ ماده ۱۲ و بند ۱۲ ماده ۱۸ ماهیت، آثار و دلایل تبعیض در زمینه محدودیت‌های واردات، مورد توجه کامل قرار دهد. بند ۲ یکی از شرایطی که در بند ۲ در نظر گرفته شده است، وضعیتی است که طرف متعاهد دارای مانده‌هایی است که در نتیجه معاملات جاری به دست آمده و خود را قادر به استفاده از آن بدون معیار تبعیض نمی‌داند. در ماده پانزدهم بند ۴ کلمه «ناامید کردن» برای مثال نشان می‌دهد که نقض حروف هر یک از ماده‌های این موافقتنامه از طریق اقدام مبادله‌ای، در صورتی که در عمل، انحراف محسوسی از هدف این ماده وجود نداشته باشد، نقض آن ماده تلقی نخواهد شد. بنابراین، یک طرف متعاهدی که به عنوان بخشی از کنترل مبادلاتی خود مطابق با مواد موافقتنامه صندوق بین‌المللی پول عمل می‌کرد، مستلزم دریافت پرداخت برای صادرات خود به ارز خود یا به ارز یک یا چند عضو صندوق بین‌المللی پول، در نتیجه مغایر با ماده یازدهم یا سیزدهم تلقی نخواهد شد. مثال دیگر می تواند طرف متعاهدی باشد که در مجوز واردات کشوری را که کالا از آن ممکن است وارد شود مشخص می کند، نه به منظور وارد کردن هرگونه عنصر تبعیض اضافی در سیستم مجوز واردات خود، بلکه برای اعمال کنترل های مجاز مبادله ای. ماده شانزدهم معافیت کالای صادراتی از عوارض یا مالیاتی که محصول مشابه آن را برای مصرف داخلی متحمل می‌شود، یا بخشودگی این عوارض یا مالیات‌ها به مقداری که بیش از مقداری که تعلق گرفته باشد، یارانه تلقی نمی‌شود. بخش B ۱. هیچ چیز در بخش B مانع استفاده طرف متعاهد از نرخ های چندگانه مبادله مطابق با مواد موافقتنامه صندوق بین المللی پول نمی شود.

۲. از نظر بخش B، "محصول اولیه" به هر محصول مزرعه، جنگل یا ماهیگیری، یا هر ماده معدنی، به شکل طبیعی خود یا که برای آماده کردن آن برای بازاریابی در حجم قابل توجهی در تجارت بین‌المللی مورد نیاز است، فرآوری شده است. بند ۳ ۱. این واقعیت که یک طرف متعاهد محصول مورد نظر را در طول دوره نمایندگی قبلی صادر نکرده است، به خودی خود مانع از آن نخواهد بود که طرف متعاهد حق خود را برای به دست آوردن سهمی از تجارت در محصول مورد نظر ایجاد کند.

۲. سیستمی برای تثبیت قیمت داخلی یا بازگشت کالای اولیه به تولیدکنندگان داخلی مستقل از حرکات قیمت‌های صادراتی که در مواقعی منجر به فروش محصول برای صادرات به قیمتی کمتر از قیمت قابل مقایسه برای کالای مشابه به خریداران در بازار داخلی می‌شود، در نظر گرفته می‌شود که شامل یارانه صادراتی به معنای بند ۳ نمی‌شود: در نتیجه، در فروش محصول برای صادرات به قیمتی بالاتر از قیمت قابل مقایسه برای کالای مشابه به خریداران در بازار داخلی؛ و این سیستم به گونه‌ای عمل می‌کند، یا به گونه‌ای طراحی شده است که به‌دلیل مقررات مؤثر تولید و یا به‌طور دیگری، صادرات را به‌طور ناروا یا به‌طور جدی برای لطمه زدن به منافع سایر طرف‌های متعاهد تحریک نکند. علی‌رغم چنین تصمیمی توسط طرف‌های متعاهد، عملیات تحت چنین سیستمی مشمول مقررات بند ۳ خواهد بود، در صورتی که تمام یا قسمتی از آن از محل بودجه دولتی و همچنین وجوه جمع‌آوری‌شده از تولیدکنندگان در رابطه با محصول مورد نظر تأمین شود. بند ۴ هدف بند ۴ این است که طرف‌های متعاهد باید قبل از پایان سال ۱۹۵۷ به توافق برسند تا تمام یارانه‌های باقی‌مانده را از اول ژانویه ۱۹۵۸ لغو کنند. یا در صورت عدم موفقیت، به توافق برسند تا اعمال توقف را تا اولین تاریخ پس از آن تمدید کنند که تا آن زمان می توانند انتظار دستیابی به چنین توافقی را داشته باشند. ماده هفدهم بند ۱ عملیات هیئت های بازاریابی که توسط طرفین متعاهد ایجاد می شود و به خرید یا فروش می پردازند مشمول مقررات بندهای (الف) و (ب) می باشد. فعالیت‌های هیئت‌های بازاریابی که توسط طرف‌های متعاهد ایجاد می‌شوند و خرید و فروش نمی‌کنند، اما مقرراتی را وضع می‌کنند که تجارت خصوصی را پوشش می‌دهد، توسط مواد مربوطه این موافقت‌نامه کنترل می‌شود. اخذ قیمت‌های متفاوت توسط یک مؤسسه دولتی برای فروش محصول خود در بازارهای مختلف، مشروط بر اینکه چنین قیمت‌های متفاوتی به دلایل تجاری برای تأمین شرایط عرضه و تقاضا در بازارهای صادراتی اعمال شود، مانع از مفاد این ماده نیست. بند ۱ (الف) اقدامات دولتی اعمال شده برای اطمینان از استانداردهای کیفیت و کارایی در عملیات تجارت خارجی، یا امتیازاتی که برای بهره برداری از منابع طبیعی ملی اعطا می شود، اما به دولت اجازه اعمال کنترل بر فعالیت های تجاری شرکت مورد نظر را نمی دهد، «امتیازات انحصاری یا ویژه» محسوب نمی شود. بند ۱ (ب) کشوری که "وام مقید" دریافت می کند آزاد است که این وام را هنگام خرید الزامات در خارج از کشور به عنوان "ملاحظه تجاری" در نظر بگیرد. بند ۲ اصطلاح "کالا" محدود به محصولاتی است که در رویه تجاری درک می شود و شامل خرید یا فروش خدمات نمی شود. بند ۳ مذاکراتی که طرفهای متعاهد بر اساس این بند موافقت می‌کنند ممکن است به سمت کاهش عوارض و سایر هزینه‌های واردات و صادرات یا انعقاد هرگونه ترتیبات رضایت‌بخش متقابل دیگر مطابق با مفاد این موافقتنامه باشد. (به بند ۴ ماده ۲ و تبصره آن بند رجوع کنید.) بند ۴ (ب) اصطلاح "کاهش واردات" در این بند نشان دهنده حاشیه ای است که توسط آن قیمتی که توسط انحصار واردات برای کالای وارداتی (به استثنای مالیات های داخلی در محدوده ماده ۳، حمل و نقل، توزیع و سایر هزینه های ناشی از حاشیه خرید، فروش، سود ناشی از فرآیند خرید، فروش، سود بیشتر است) بیشتر می شود. هزینه در ماده هجدهم طرف‌های متعاهد و طرف‌های متعاهد ذی‌نفع در رابطه با موضوعات ناشی از این ماده نهایت محرمانه بودن را حفظ خواهند کرد. بندهای ۱ و ۴ ۱. طرف‌های متعاهد وقتی بررسی می‌کنند که آیا اقتصاد یک طرف متعاهد «فقط می‌تواند از استانداردهای پایین زندگی پشتیبانی کند»، باید آن‌ها را در نظر بگیرند. موقعیت عادی آن اقتصاد است و نباید تصمیم خود را بر اساس شرایط استثنایی از قبیل شرایطی که ممکن است از وجود موقت شرایط استثنایی مساعد برای کالا یا محصولات صادراتی اصلی آن طرف متعاهد ناشی شود، استوار کند.

۲. منظور از عبارت "در مراحل اولیه توسعه" فقط برای طرفهای متعاهدی نیست که به تازگی توسعه اقتصادی خود را آغاز کرده اند، بلکه برای طرفهای متعاهدی که اقتصاد آنها در حال گذراندن فرآیند صنعتی شدن برای اصلاح وابستگی بیش از حد به تولید اولیه هستند نیز کاربرد دارد. بندهای ۲، ۳، ۷، ۱۳ و ۲۲ اشاره به ایجاد صنایع خاص نه تنها در مورد ایجاد صنعت جدید، بلکه در مورد ایجاد شاخه جدیدی از تولید در یک صنعت موجود و تحول اساسی یک صنعت موجود، و به گسترش قابل توجه یک صنعت موجود که بخش نسبتاً کمی از تقاضای داخلی را تأمین می کند، اعمال می شود. همچنین باید بازسازی صنعتی را که در نتیجه خصومت ها یا بلایای طبیعی تخریب شده یا به شدت آسیب دیده است، پوشش دهد. بند ۷ (ب) اصلاح یا انصراف، مطابق بند ۷ (ب)، توسط یک طرف متعاهد، غیر از طرف متعاهد متقاضی، که در بند ۷ (الف) ذکر شده است، ظرف شش ماه از روزی که اقدام توسط طرف متعاهد متقاضی انجام می‌شود، انجام می‌شود و در سی امین روز پس از روزی که این اصلاحیه یا خروج به CONINGPARES اعلام شده است، لازم‌الاجرا خواهد شد. بند ۱۱ جمله دوم در بند ۱۱ نباید به این معنا تفسیر شود که طرف متعاهد ملزم به کاهش یا حذف محدودیت‌ها است، در صورتی که این تخفیف یا حذف شرایطی را ایجاد کند که به ترتیب تشدید یا ایجاد محدودیت‌های مندرج در بند ۹ ماده ۱۸ را توجیه می‌کند. بند ۱۲ (ب) تاریخ مذکور در بند ۱۲ (ب) تاریخی است که توسط طرفهای متعاهد مطابق با مفاد بند ۴ (ب) ماده دوازدهم این موافقتنامه تعیین می شود. بندهای ۱۳ و ۱۴ مشخص شده است که قبل از تصمیم گیری در مورد معرفی یک اقدام و اطلاع طرف های متعاهد مطابق بند ۱۴، یک طرف قرارداد ممکن است به یک دوره زمانی معقول برای ارزیابی موقعیت رقابتی صنعت مربوطه نیاز داشته باشد. بندهای ۱۵ و ۱۶ این قابل درک است که طرفهای متعاهد از طرف متعاهدی که پیشنهاد اعمال اقدامی را طبق بخش C دارد دعوت خواهند کرد تا در صورت درخواست طرف متعاهدی که تجارت آن به طور محسوسی تحت تأثیر اقدام مورد نظر قرار می گیرد، مطابق بند ۱۶ با آنها مشورت کند. بندهای ۱۶، ۱۸، ۱۹ و ۲۲ ۱. قابل درک است که طرفین متعاهد ممکن است موافقت کنند. در یک اقدام پیشنهادی مشروط به شرایط یا محدودیت‌های خاص. اگر اقدام اعمال شده با شرایط توافق مطابقت نداشته باشد، تا حدی اقدامی تلقی می‌شود که طرف‌های متعاهد با آن موافقت نکرده‌اند. در مواردی که طرفهای متعاهد در یک اقدام برای مدت معینی موافقت کرده‌اند، طرف متعاهد مربوط، در صورتی که تشخیص دهد که برای دستیابی به هدفی که در ابتدا برای آن اقدام انجام شده است، حفظ آن اقدام برای مدت زمان بیشتری لازم است، می‌تواند برای طرف‌های متعاهد برای تمدید آن دوره مطابق با مفاد و رویه‌های بند «د» درخواست کند.

۲. انتظار می‌رود که طرف‌های متعاهد معمولاً از توافق در مورد اقدامی که احتمالاً به صادرات کالایی که اقتصاد یک طرف متعاهد عمدتاً به آن وابسته است آسیب جدی وارد کند، خودداری کنند. پاراگراف ۱۸ و ۲۲ عبارت "اینکه از منافع سایر طرف های متعاهد به اندازه کافی محافظت می شود" به این منظور است که عرض جغرافیایی کافی را فراهم کند تا در هر مورد مناسب ترین روش حفاظت از این منافع را در نظر بگیرد. برای مثال، روش مناسب ممکن است به شکل یک امتیاز اضافی توسط طرف متعاهدی که به بخش C یا D متوسل می شود در مدت زمانی که انحراف از سایر مواد موافقتنامه به قوت خود باقی می ماند یا تعلیق موقت توسط هر طرف متعاهد دیگر اشاره شده در بند ۱۸ یک امتیازی که اساساً به دلیل عدم معادل بودن یک اقدام امتیازی است، اعمال شود. چنین طرف متعاهدی این حق را خواهد داشت که از طریق چنین تعلیق موقت یک امتیاز، از منافع خود محافظت کند. مشروط بر اینکه این حق زمانی اعمال نخواهد شد که در مورد اقدامی که توسط یک طرف متعاهد در محدوده بند ۴ (الف) اعمال می‌شود، طرف‌های متعاهد تشخیص داده‌اند که میزان امتیاز جبرانی پیشنهادی کافی است. بند ۱۹ منظور از مفاد بند ۱۹ مواردی است که صنعتی بیش از "مدت زمانی معقول" ذکر شده در تبصره بندهای ۱۳ و ۱۴ وجود داشته است و نباید به گونه ای تفسیر شود که طرف متعاهدی را که در محدوده بند ۴ (الف) ماده هفدهم از جمله بند ج، از جمله موارد تجدید نظر در بند ج است، از حق خود محروم کند. ۱۷، با توجه به صنعت تازه تاسیس، حتی اگر از حمایت اتفاقی ناشی از محدودیت های واردات تراز پرداخت ها بهره مند شده باشد. بند ۲۱ هر اقدامی که طبق مفاد بند ۲۱ اتخاذ شده باشد، در صورتی که اقدام انجام شده مطابق بند ۱۷ پس گرفته شود یا طرفهای متعاهد با این اقدام موافق باشند، فوراً لغو خواهد شد. پیشنهاد شده پس از انقضای مهلت نود روزه تعیین شده در بند ۱۷. تبصره ماده XX بند (ح) استثناء مقرر در این بند شامل هر قرارداد کالایی است که مطابق با اصول مصوب شورای اقتصادی و اجتماعی در قطعنامه ۳۰ (IV) مورخ ۲۸ مارس ۱۹۴۷ باشد. هنگامی که محصولی که به قلمرو یکی از اعضای اتحادیه گمرکی یا منطقه آزاد تجاری با نرخ ترجیحی عوارض وارد شده است، مجدداً به قلمرو عضو دیگر آن اتحادیه یا منطقه صادر می شود، عضو اخیر باید مالیاتی معادل تفاوت بین عوارض پرداخت شده قبلی و هر گونه عوارض بالاتری که در صورت واردات محصول مستقیماً به قلمرو آن کشور قابل پرداخت است، دریافت کند. بند ۱۱ اقدامات اتخاذ شده توسط هند و پاکستان به منظور اجرای ترتیبات تجاری قطعی بین آنها، پس از توافق بر سر آنها، ممکن است از مفاد خاص این موافقتنامه خارج شود، اما این اقدامات به طور کلی با اهداف موافقتنامه سازگار خواهد بود. در ماده بیست و هشتم طرفهای متعاهد و هر یک از طرفهای متعاهد مربوط باید ترتیبی دهند که مذاکرات و مشاوره‌ها را با بیشترین محرمانه انجام دهند تا از افشای زودهنگام جزئیات تغییرات احتمالی تعرفه جلوگیری شود. طرفهای متعاهد باید فوراً از کلیه تغییرات تعرفه های ملی ناشی از توسل به این ماده مطلع شوند. بند ۱ ۱. اگر طرف‌های متعاهد دوره‌ای غیر از دوره سه ساله را تعیین کنند، یک طرف متعاهد می‌تواند طبق بند ۱ یا بند ۳ ماده ۲۸ در اولین روز پس از انقضای این دوره دیگر عمل کند و، مگر اینکه طرف‌های متعاهد مجدداً دوره دیگری را تعیین کرده باشند، دوره‌ای سه ساله بعد از آن مشخص خواهد شد.

۲. مقرره ای که در ۱ ژانویه ۱۹۵۸ و در روزهای دیگر تعیین شده به موجب بند ۱، یک طرف متعاهد "می تواند ... امتیاز را تغییر دهد یا پس بگیرد" به این معنی است که در چنین روزی و در اولین روز پس از پایان هر دوره، تعهد قانونی آن طرف متعاهد طبق ماده ۲ تغییر می کند. این بدان معنا نیست که تغییرات در تعرفه گمرکی آن لزوماً باید در آن روز اعمال شود. اگر تغییر تعرفه ناشی از مذاکرات انجام شده طبق این ماده به تأخیر بیفتد، لازم الاجرا شدن هر امتیاز جبرانی ممکن است به همین ترتیب به تأخیر بیفتد.

۳. نه زودتر از شش ماه و نه دیرتر از سه ماه، قبل از ۱ ژانویه ۱۹۵۸، یا تا تاریخ خاتمه هر دوره بعدی، طرف متعاهدی که مایل به تغییر یا لغو هر امتیاز مندرج در جدول مناسب است، باید به طرفهای متعاهد این موضوع را اطلاع دهد. اثر طرفهای متعاهد باید طرف یا طرفهای متعاهدی را که مذاکرات یا مشورتهای مذکور در بند ۱ با آنها انجام خواهد شد، تعیین خواهند کرد. هر طرف متعاهدی که به این ترتیب تعیین شده باشد، باید در چنین مذاکرات یا مشاوره هایی با طرف متعاهد متقاضی با هدف دستیابی به توافق قبل از پایان دوره شرکت کند. هر گونه تمدید عمر تضمین شده برنامه ها به برنامه هایی مربوط می شود که پس از چنین مذاکراتی مطابق با بندهای ۱، ۲ و ۳ ماده ۲۸ اصلاح شده است. اگر طرف‌های متعاهد ترتیبی دهند که مذاکرات تعرفه‌ای چندجانبه در بازه زمانی شش ماهه قبل از اول ژانویه ۱۹۵۸ یا قبل از هر روزی که طبق بند ۱ تعیین می‌شود انجام شود، باید در ترتیبات این مذاکرات، رویه‌های مناسبی را برای انجام مذاکرات مذکور در این بند لحاظ کنند.

۴. هدف از پیش‌بینی مشارکت در مذاکرات هر یک از طرف‌های متعاهد با اصل منفعت تأمین‌کننده، علاوه بر هر یک از طرف‌های متعاهدی که امتیاز با آن در ابتدا مذاکره شده بود، این است که اطمینان حاصل شود که طرف متعاهدی که سهم بیشتری در تجارت متاثر از امتیاز دارد نسبت به طرف متعاهدی که امتیاز در ابتدا با آن مذاکره شده است، از فرصت مؤثری برخوردار باشد که بر اساس این توافقنامه از آن محافظت کند. از سوی دیگر، منظور این نیست که دامنه مذاکرات به گونه ای باشد که مذاکرات و توافق بر اساس ماده بیست و هشتم را بی جهت دشوار سازد و یا در اجرای این ماده در آینده برای امتیازاتی که حاصل مذاکرات بر اساس آن است، عوارض ایجاد کند. بر این اساس، طرف‌های متعاهد تنها در صورتی باید تعیین کنند که یک طرف متعاهد دارای منفعت تامین اصلی باشد که آن طرف متعاهد، در یک دوره زمانی معقول قبل از مذاکرات، سهم بیشتری در بازار طرف متعاهد متقاضی داشته باشد تا طرف متعاهدی که امتیاز در ابتدا با آن مذاکره شده است یا به تشخیص طرف متعاهد، در غیاب شریک متعاهد، چنین سهمی را داشته است. محدودیت های حفظ شده توسط طرف قرارداد متقاضی. بنابراین برای طرفهای متعاهد تشخیص اینکه بیش از یک طرف متعاهد، یا در موارد استثنایی که تقریباً برابری بیش از دو طرف متعاهد وجود دارد، نفع تامین اصلی داشته باشند، مناسب نخواهد بود.

۱. The contracting parties shall collaborate jointly, with the framework of this Agreement and elsewhere, as appropriate, to further the objectives set forth in Article XXXVI.

۲. In particular, the CONTRACTING PARTIES PARTIES shall:

(a) where appropriate, take action, including action through international arrangements, to provide improved and acceptable conditions of access to world markets for primary products of particular interest to less-developed contracting parties and to devise measures designed to stabilize and improve conditions of world markets in these products including measures designed to attain stable, equitable and remunerative prices for exports of such products;

(b) seek appropriate collaboration in matters of trade and development policy with the United Nations and its organs and agencies, including any institutions that may be created on the basis of recommendations by the United Nations Conference on Trade and Development;

(c) collaborate in analyzing the development plans and policies of individual less-developed contracting parties and in examining trade and aid relationships with a view to devising concrete measures to promote the development of export potential and to facilitate access to export markets for the products of the industries thus developed and, in this connexion, seek appropriate collaboration with governments and international organizations, and in particular with organizations having competence in relation to financial assistance for economic development, in systematic studies of trade and aid relationships in individual less-developed contracting parties aimed at obtaining a clear analysis of export potential, market prospects and any further action that may be required;

(d) keep under continuous review the development of world trade with special reference to the rate of growth of the trade of less-developed contracting parties and make such recommendations to contracting parties as may, in the circumstances, be deemed appropriate;

(e) collaborate in seeking feasible methods to expand trade for the purpose of economic development, through international harmonization and adjustment of national policies and regulations, through technical and commercial standards affecting production, transportation and marketing, and through export promotion by the establishment of facilities for the increased flow of trade information and the development of market research; and

(f) establish such institutional arrangements as may be necessary to further the objectives set forth in Article XXXVI and to give effect to the provisions of this Part.

Certain of the territories listed above have two or more preferential rates in force for certain products. Any such territory may, by agreement with the other contracting parties which are principal suppliers of such products at the most-favoured-nation rate, substitute for such preferential rates a single preferential rate which shall not on the whole be less favourable to suppliers at the most-favoured-nation rate than the preferences in force prior to such substitution.

The imposition of an equivalent margin of tariff preference to replace a margin of preference in an internal tax existing on April ۱۰, ۱۹۴۷, exclusively between two or more of the territories listed in this Annex or to replace the preferential quantitative arrangements described in the following paragraph, shall not be deemed to constitute an increase in a margin of tariff preference.

The preferential arrangements referred to in paragraph ۵ (b) of Article XIV are those existing in the United Kingdom on April ۱۰, ۱۹۴۷, under contractual agreements with the Governments of Canada, Australia and New Zealand, in respect of chilled and frozen beef and veal, frozen mutton and lamb, chilled and frozen pork, and bacon. It is the intention, without prejudice to any action taken under subparagraph (h) of Article XX, that these arrangements shall be eliminated or replaced by tariff preferences, and that negotiations to this end shall take place as soon as practicable among the countries substantially concerned or involved.

The film hire tax in force in New Zealand on April ۱۰, ۱۹۴۷, shall, for the purposes of this Agreement, be treated as a customs duty under Article I. The renters' film quota in force in New Zealand on April ۱۰, ۱۹۴۷, shall, for the purposes of this Agreement, be treated as a screen quota under Article IV.

The Dominions of India and Pakistan have not been mentioned separately in the above list since they had not come into existence as such on the base date of ۱۰ April, ۱۹۴۷.

NOTES AND SUPPLEMENTARY PROVISIONS

Ad Article I

Paragraph ۱

The obligations incorporated in paragraph ۱ of Article I by reference to paragraphs ۲ and ۴ of Article III and those incorporated in paragraph ۲ (b) of Article II by reference to Article VI shall be considered as falling within Part II for the purposes of the Protocol of Provisional Application.

The cross references, in the paragraph immediately above and in paragraph ۱ of Article I, to paragraphs ۲ and ۴ of Article III shall only apply after Article III has been modified by the entry into force of the amendment provided for in the Protocol Modifying Part II and Article XXVI of the General Agreement on Tariffs and Trade, dated ۱۴ September, ۱۹۴۸.

Paragraph ۴

The term "margin of preference" means the absolute difference between the most-favoured-nation rate of duty and the preferential rate of duty for the like product, and not the proportionate relation between those rates. As examples:

۱.) If the most-favoured-nation rate were ۳۶ per cent ad valorem and the preferential rate were ۲۴ per cent ad valorem, the margin of preference would be ۱۲ per cent ad valorem, and not one-third of the most-favoured-nation rate;

۲.) the most-favoured-nation rate were ۳۶ per cent ad valorem and the preferential rate were expressed as two-thirds of the most-favoured-nation rate, the margin of preference would be ۱۲ per cent ad valorem;

۳.) the most-favoured-nation rate were ۲ francs per kilogram and the preferential rate were ۱.۵۰ francs per kilogram, the margin of preference would be ۰.۵۰ francs per kilogram.

The following kinds of customs action, taken in accordance with established uniform procedures, would not be contrary to a general binding of margins of preference:

the re-application to an imported product of a tariff classification or rate of duty, properly applicable to such product, in cases in which the application of such classification or rate to such product was temporarily suspended or inoperative on April ۱۰, ۱۹۴۷; and

the classification of a particular product under a tariff item other than that under which importations of that product were classified on April ۱۰, ۱۹۴۷, in cases in which the tariff law clearly contemplates that such product may be classified under more than one tariff item.

Ad Article II

Paragraph ۲ (a)

The cross reference, in paragraph ۲ (a) of Article II, to paragraph ۲ of Article III shall only apply after Article III has been modified by the entry into force of the amendment provided for in the Protocol Modifying Part II and Article XXVI of the General Agreement on Tariffs and Trade, dated ۱۴ September ۱۹۴۸.

See the note relating to paragraph ۱ of Article I.

Paragraph ۴

Except where otherwise specifically agreed between the contracting parties which initially negotiated the concession, the provisions of this paragraph will be applied in the light of the provisions of Article ۳۱ of the Havana Charter.

Ad Article III

Any internal tax or other internal charge, or any law, regulation or requirement of the kind referred to in paragraph ۱ which applies to an imported product and to the like domestic product and is collected or enforced in the case of the imported product at the time or point of importation, is nevertheless to be regarded as an internal tax or other internal charge, or a law, regulation or requirement of the kind referred to in paragraph ۱, and is accordingly subject to the provisions of article III.

Paragraph ۱

The application of paragraph ۱ to internal taxes imposed by local governments and authorities within the territory of a contracting party is subject to the provisions of the final paragraph of article XXIV. The term "reasonable measures" in the last-mentioned paragraph would not require, for example, the repeal of existing national legislation authorizing local governments to impose internal taxes which, although technically inconsistent with the letter of article III are not in fact inconsistent with its spirit, if such repeal would result in a serious financial hardship for the local governments or authorities concerned. With regard to taxation by local governments or authorities which is inconsistent with both the letter and spirit of article III, the term "reasonable measures" would permit a contracting party to eliminate the inconsistent taxation gradually over a transition period, if abrupt action would create serious administrative and financial difficulties.

Paragraph ۲

A tax conforming to the requirements of the first sentence of paragraph ۲ would be considered to be inconsistent with the provisions of the second sentence only in cases where competition was involved between, on the one hand, the taxed product and on the other hand, a directly competitive or substitutable product which was not similarly taxed.

Paragraph ۵

Regulations consistent with the provisions of the first sentence of paragraph ۵ shall not be considered to be contrary to the provisions of the second sentence in any case in which all of the products subject to the regulations are produced domestically in substantial quantities. A regulation cannot be justified as being consistent with the provisions of the second sentence on the ground that the proportion or amount allocated to each of the products which are the subject of the regulation constitutes an equitable relationship between imported and domestic products.

Ad Article V

Paragraph ۵

With regard to transportation charges, the principle laid down in paragraph ۵ refers to like products being transported on the same route under like conditions.

Ad Article VI

Paragraph ۱

۱. Hidden dumping by associated houses (that is, the sale by an importer at a price below that corresponding to the price invoiced by an exporter with whom the importer is associated, and also below the price in the exporting country) constitutes a form of price dumping with respect to which the margin of dumping may be calculated on the basis of the price at which the goods are resold by the importer.

۲. It is recognized that, in the case of imports from a country which has a complete or substantially complete monopoly of its trade and where all domestic prices are fixed by the State, special difficulties may exist in determining price comparability for the purposes of paragraph ۱, and in such cases importing contracting parties may find it necessary to take into account the possibility that a strict comparison with domestic prices in such a country may not always be appropriate.

Paragraphs ۲ and ۳

۱. As in many other cases in customs administration, a contracting party may require reasonable security (bond or cash deposit) for the payment of anti-dumping or countervailing duty pending final determination of the facts in any case of suspected dumping or subsidization.

۲. Multiple currency practices can in certain circumstances constitute a subsidy to exports which may be met by countervailing duties under paragraph ۳ or can constitute a form of dumping by means of a partial depreciation of a country's currency which may be met by action under paragraph
۲. By "multiple currency practices" is meant practices by Governments or sanctioned by Governments.

Paragraph ۶ (b)

Waivers under the provisions of this sub-paragraph shall be granted only on application by the contracting party proposing to levy an anti-dumping or countervailing duty, as the case may be.

Ad Article VII

Paragraph ۱

The expression "or other charges" is not to be regarded as including internal taxes or equivalent charges imposed on or in connection with imported products.

Paragraph ۲

۱. It would be in conformity with Article VII to presume that "actual value" may be represented by the invoice price, plus any non-included charges for legitimate costs which are proper elements of "actual value" and plus any abnormal discount or other reduction from the ordinary competitive price.

۲. It would be in conformity with Article VII, paragraph ۲ (b), for a contracting party to construe the phrase "in the ordinary course of trade . . . under fully competitive conditions", as excluding any transaction wherein the buyer and seller are not independent of each other and price is not the sole consideration.

۳. The standard of "fully competitive conditions" permits a contracting party to exclude from consideration prices involving special discounts limited to exclusive agents.

۴. The wording of subparagraphs (a) and (b) permits a contracting party to determine the value for customs purposes uniformly either (۱) on the basis of a particular exporter's prices of the imported merchandise, or (۲) on the basis of the general price level of like merchandise.

Ad Article VIII

۱. While Article VIII does not cover the use of multiple rates of exchange as such, paragraphs ۱ and ۴ condemn the use of exchange taxes or fees as a device for implementing multiple currency practices; if, however, a contracting party is using multiple currency exchange fees for balance of payments reasons with the approval of the International Monetary Fund, the provisions of paragraph ۹ (a) of Article XV fully safeguard its position.

۲. It would be consistent with paragraph ۱ if, on the importation of products from the territory of a contracting party into the territory of another contracting party, the production of certificates of origin should only be required to the extent that is strictly indispensable.

Ad Articles XI, XII, XIII, XIV and XVIII

Throughout Articles XI, XII, XIII, XIV and XVIII the terms "import restrictions" or "export restrictions" include restrictions made effective through state-trading operations.

Ad Article XI

Paragraph ۲ (c)

The term "in any form" in this paragraph covers the same products when in an early stage of processing and still perishable, which compete directly with the fresh product and if freely imported would tend to make the restriction on the fresh product ineffective.

Paragraph ۲, last subparagraph

The term "special factors" includes changes in relative productive efficiency as between domestic and foreign producers, or as between different foreign producers, but not changes artificially brought about by means not permitted under the Agreement.

Ad Article XII

The CONTRACTING PARTIES PARTIES shall make provision for the utmost secrecy in the conduct of any consultation under the provisions of this Article.

Paragraph ۳ (c)(i)

Contracting parties applying restrictions shall endeavour to avoid causing serious prejudice to exports of a commodity on which the economy of a contracting party is largely dependent.

Paragraph ۴ (b)

It is agreed that the date shall be within ninety days after the entry into force of the amendments of this Article effected by the Protocol Amending the Preamble and Parts II and III of this Agreement. However, should the CONTRACTING PARTIES PARTIES find that conditions were not suitable for the application of the provisions of this sub-paragraph at the time envisaged, they may determine a later date; Provided that such date is not more than thirty days after such time as the obligations of Article VIII, Sections ۲, ۳ and ۴, of the Articles of Agreement of the International Monetary Fund become applicable to contracting parties, members of the Fund, the combined foreign trade of which constitutes at least fifty per centum of the aggregate foreign trade of all contracting parties.

Paragraph ۴ (e)

It is agreed that paragraph ۴ (e) does not add any new criteria for the imposition or maintenance of quantitative restrictions for balance of payments reasons. It is solely intended to ensure that all external factors such as changes in the terms of trade, quantitative restrictions, excessive tariffs and subsidies, which may be contributing to the balance of payments difficulties of the contracting party applying restrictions will be fully taken into account.

Ad Article XIII

Paragraph ۲ (d)

No mention was made of "commercial considerations" as a rule for the allocation of quotas because it was considered that its application by governmental authorities might not always be practicable. Moreover, in cases where it is practicable, a contracting party could apply these considerations in the process of seeking agreement, consistently with the general rule laid down in the opening sentence of paragraph ۲.

Paragraph ۴

See note relating to "special factors" in connection with the last sub-paragraph of paragraph ۲ of Article XI.

Ad Article XIV

Paragraph ۱

The provisions of this paragraph shall not be so construed as to preclude full consideration by the CONTRACTING PARTIES PARTIES, in the consultations provided for in paragraph ۴ of Article XII and in paragraph ۱۲ of Article XVIII, of the nature, effects and reasons for discrimination in the field of import restrictions.

Paragraph ۲

One of the situations contemplated in paragraph ۲ is that of a contracting party holding balances acquired as a result of current transactions which it finds itself unable to use without a measure of discrimination.

Ad Article XV

Paragraph ۴

The word "frustrate" is intended to indicate, for example, that infringements of the letter of any Article of this Agreement by exchange action shall not be regarded as a violation of that Article if, in practice, there is no appreciable departure from the intent of the Article. Thus, a contracting party which, as part of its exchange control operated in accordance with the Articles of Agreement of the International Monetary Fund, requires payment to be received for its exports in its own currency or in the currency of one or more members of the International Monetary Fund will not thereby be deemed to contravene Article XI or Article XIII. Another example would be that of a contracting party which specifies on an import licence the country from which the goods may be imported, for the purpose not of introducing any additional element of discrimination in its import licensing system but of enforcing permissible exchange controls.

Ad Article XVI

The exemption of an exported product from duties or taxes borne by the like product when destined for domestic consumption, or the remission of such duties or taxes in amounts not in excess of those which have accrued, shall not be deemed to be a subsidy.

Section B

۱. Nothing in Section B shall preclude the use by a contracting party of multiple rates of exchange in accordance with the Articles of Agreement of the International Monetary Fund.

۲. For the purposes of Section B, a "primary product" is understood to be any product of farm, forest or fishery, or any mineral, in its natural form or which has undergone such processing as is customarily required to prepare it for marketing in substantial volume in international trade.

Paragraph ۳

۱. The fact that a contracting party has not exported the product in question during the previous representative period would not in itself preclude that contracting party from establishing its right to obtain a share of the trade in the product concerned.

۲. A system for the stabilization of the domestic price or of the return to domestic producers of a primary product independently of the movements of export prices, which results at times in the sale of the product for export at a price lower than the comparable price charged for the like product to buyers in the domestic market, shall be considered not to involve a subsidy on exports within the meaning of paragraph ۳ if the CONTRACTING PARTIES PARTIES determine that:

the system has also resulted, or is so designed as to result, in the sale of the product for export at a price higher than the comparable price charged for the like product to buyers in the domestic market; and

the system is so operated, or is designed so to operate, either because of the effective regulation of production or otherwise, as not to stimulate exports unduly or otherwise seriously to prejudice the interests of other contracting parties.

Notwithstanding such determination by the CONTRACTING PARTIES PARTIES, operations under such a system shall be subject to the provisions of paragraph ۳ where they are wholly or partly financed out of government funds in addition to the funds collected from producers in respect of the product concerned.

Paragraph ۴

The intention of paragraph ۴ is that the contracting parties should seek before the end of ۱۹۵۷ to reach agreement to abolish all remaining subsidies as from ۱ January ۱۹۵۸; or, failing this, to reach agreement to extend the application of the standstill until the earliest date thereafter by which they can expect to reach such agreement.

Ad Article XVII

Paragraph ۱

The operations of Marketing Boards, which are established by contracting parties and are engaged in purchasing or selling, are subject to the provisions of sub-paragraphs (a) and (b).

The activities of Marketing Boards which are established by contracting parties and which do not purchase or sell but lay down regulations covering private trade are governed by the relevant Articles of this Agreement.

The charging by a State enterprise of different prices for its sales of a product in different markets is not precluded by the provisions of this Article, provided that such different prices are charged for commercial reasons, to meet conditions of supply and demand in export markets.

Paragraph ۱ (a)

Governmental measures imposed to ensure standards of quality and efficiency in the operation of external trade, or privileges granted for the exploitation of national natural resources but which do not empower the government to exercise control over the trading activities of the enterprise in question, do not constitute "exclusive or special privileges".

Paragraph ۱(b)

A country receiving a "tied loan" is free to take this loan into account as a "commercial consideration" when purchasing requirements abroad.

Paragraph ۲

The term "goods" is limited to products as understood in commercial practice, and is not intended to include the purchase or sale of services.

Paragraph ۳

Negotiations which contracting parties agree to conduct under this paragraph may be directed towards the reduction of duties and other charges on imports and exports or towards the conclusion of any other mutually satisfactory arrangement consistent with the provisions of this Agreement. (See paragraph ۴ of Article II and the note to that paragraph.)

Paragraph ۴ (b)

The term "import mark-up" in this paragraph shall represent the margin by which the price charged by the import monopoly for the imported product (exclusive of internal taxes within the purview of Article III, transportation, distribution, and other expenses incident to the purchase, sale or further processing, and a reasonable margin of profit) exceeds the landed cost.

Ad Article XVIII

The CONTRACTING PARTIES PARTIES and the contracting parties concerned shall preserve the utmost secrecy in respect of matters arising under this Article.

Paragraphs ۱ and ۴

۱. When they consider whether the economy of a contracting party "can only support low standards of living", the CONTRACTING PARTIES PARTIES shall take into consideration the normal position of that economy and shall not base their determination on exceptional circumstances such as those which may result from the temporary existence of exceptionally favourable conditions for the staple export product or products of such contracting party.

۲. The phrase "in the early stages of development" is not meant to apply only to contracting parties which have just started their economic development, but also to contracting parties the economies of which are undergoing a process of industrialization to correct an excessive dependence on primary production.

Paragraphs ۲, ۳, ۷, ۱۳ and ۲۲

The reference to the establishment of particular industries shall apply not only to the establishment of a new industry, but also to the establishment of a new branch of production in an existing industry and to the substantial transformation of an existing industry, and to the substantial expansion of an existing industry supplying a relatively small proportion of the domestic demand. It shall also cover the reconstruction of an industry destroyed or substantially damaged as a result of hostilities or natural disasters.

Paragraph ۷ (b)

A modification or withdrawal, pursuant to paragraph ۷ (b), by a contracting party, other than the applicant contracting party, referred to in paragraph ۷ (a), shall be made within six months of the day on which the action is taken by the applicant contracting party, and shall become effective on the thirtieth day following the day on which such modification or withdrawal has been notified to the CONTRACTING PARTIES PARTIES.

Paragraph ۱۱

The second sentence in paragraph ۱۱ shall not be interpreted to mean that a contracting party is required to relax or remove restrictions if such relaxation or removal would thereupon produce conditions justifying the intensification or institution, respectively, of restrictions under paragraph ۹ of Article XVIII.

Paragraph ۱۲ (b)

The date referred to in paragraph ۱۲ (b) shall be the date determined by the CONTRACTING PARTIES PARTIES in accordance with the provisions of paragraph ۴ (b) of Article XII of this Agreement.

Paragraphs ۱۳ and ۱۴

It is recognized that, before deciding on the introduction of a measure and notifying the CONTRACTING PARTIES PARTIES in accordance with paragraph ۱۴, a contracting party may need a reasonable period of time to assess the competitive position of the industry concerned.

Paragraphs ۱۵ and ۱۶

It is understood that the CONTRACTING PARTIES PARTIES shall invite a contracting party proposing to apply a measure under Section C to consult with them pursuant to paragraph ۱۶ if they are requested to do so by a contracting party the trade of which would be appreciably affected by the measure in question.

Paragraphs ۱۶, ۱۸, ۱۹ and ۲۲

۱. It is understood that the CONTRACTING PARTIES PARTIES may concur in a proposed measure subject to specific conditions or limitations. If the measure as applied does not conform to the terms of the concurrence it will to that extent be deemed a measure in which the CONTRACTING PARTIES PARTIES have not concurred. In cases in which the CONTRACTING PARTIES PARTIES have concurred in a measure for a specified period, the contracting party concerned, if it finds that the maintenance of the measure for a further period of time is required to achieve the objective for which the measure was originally taken, may apply to the CONTRACTING PARTIES PARTIES for an extension of that period in accordance with the provisions and procedures of Section C or D, as the case may be.

۲. It is expected that the CONTRACTING PARTIES PARTIES will, as a rule, refrain from concurring in a measure which is likely to cause serious prejudice to exports of a commodity on which the economy of a contracting party is largely dependent.

Paragraph ۱۸ and ۲۲

The phrase "that the interests of other contracting parties are adequately safeguarded" is meant to provide latitude sufficient to permit consideration in each case of the most appropriate method of safeguarding those interests. The appropriate method may, for instance, take the form of an additional concession to be applied by the contracting party having recourse to Section C or D during such time as the deviation from the other Articles of the Agreement would remain in force or of the temporary suspension by any other contracting party referred to in paragraph ۱۸ of a concession substantially equivalent to the impairment due to the introduction of the measure in question. Such contracting party would have the right to safeguard its interests through such a temporary suspension of a concession; Provided that this right will not be exercised when, in the case of a measure imposed by a contracting party coming within the scope of paragraph ۴ (a), the CONTRACTING PARTIES PARTIES have determined that the extent of the compensatory concession proposed was adequate.

Paragraph ۱۹

The provisions of paragraph ۱۹ are intended to cover the cases where an industry has been in existence beyond the "reasonable period of time" referred to in the note to paragraphs ۱۳ and ۱۴, and should not be so construed as to deprive a contracting party coming within the scope of paragraph ۴ (a) of Article XVIII, of its right to resort to the other provisions of Section C, including paragraph ۱۷, with regard to a newly established industry even though it has benefited from incidental protection afforded by balance of payments import restrictions.

Paragraph ۲۱

Any measure taken pursuant to the provisions of paragraph ۲۱ shall be withdrawn forthwith if the action taken in accordance with paragraph ۱۷ is withdrawn or if the CONTRACTING PARTIES PARTIES concur in the measure proposed after the expiration of the ninety-day time limit specified in paragraph ۱۷.

Ad Article XX

Sub-paragraph (h)

The exception provided for in this sub-paragraph extends to any commodity agreement which conforms to the principles approved by the Economic and Social Council in its Resolution ۳۰ (IV) of ۲۸ March ۱۹۴۷.

Ad Article XXIV

Paragraph ۹

It is understood that the provisions of Article I would require that, when a product which has been imported into the territory of a member of a customs union or free-trade area at a preferential rate of duty is re-exported to the territory of another member of such union or area, the latter member should collect a duty equal to the difference between the duty already paid and any higher duty that would be payable if the product were being imported directly into its territory.

Paragraph ۱۱

Measures adopted by India and Pakistan in order to carry out definitive trade arrangements between them, once they have been agreed upon, might depart from particular provisions of this Agreement, but these measures would in general be consistent with the objectives of the Agreement.

Ad Article XXVIII

The CONTRACTING PARTIES PARTIES and each contracting party concerned should arrange to conduct the negotiations and consultations with the greatest possible secrecy in order to avoid premature disclosure of details of prospective tariff changes. The CONTRACTING PARTIES PARTIES shall be informed immediately of all changes in national tariffs resulting from recourse to this Article.

Paragraph ۱

۱. If the CONTRACTING PARTIES PARTIES specify a period other than a three-year period, a contracting party may act pursuant to paragraph ۱ or paragraph ۳ of Article XXVIII on the first day following the expiration of such other period and, unless the CONTRACTING PARTIES PARTIES have again specified another period, subsequent periods will be three-year periods following the expiration of such specified period.

۲. The provision that on ۱ January ۱۹۵۸, and on other days determined pursuant to paragraph ۱, a contracting party "may .. . modify or withdraw a concession" means that on such day, and on the first day after the end of each period, the legal obligation of such contracting party under Article II is altered; it does not mean that the changes in its customs tariff should necessarily be made effective on that day. If a tariff change resulting from negotiations undertaken pursuant to this Article is delayed, the entry into force of any compensatory concessions may be similarly delayed.

۳. Not earlier than six months, nor later than three months, priorto ۱ January ۱۹۵۸, or to the termination date of any subsequentperiod, a contracting party wishing to modify or withdraw anyconcession embodied in the appropriate Schedule, should notify theCONTRACTING PARTIES PARTIES to this effect. The CONTRACTING PARTIES PARTIES shall thendetermine the contracting party or contracting parties with which thenegotiations or consultations referred to in paragraph ۱ shall takeplace. Any contracting party so determined shall participate in suchnegotiations or consultations with the applicant contracting partywith the aim of reaching agreement before the end of the period. Anyextension of the assured life of the Schedules shall relate to theSchedules as modified after such negotiations, in accordance withparagraphs ۱, ۲, and ۳ of Article XXVIII. If the CONTRACTING PARTIES PARTIESare arranging for multilateral tariff negotiations to take placewithin the period of six months before ۱ January ۱۹۵۸, or before anyother day determined pursuant to paragraph ۱, they shall include inthe arrangements for such negotiations suitable procedures forcarrying out the negotiations referred to in this paragraph.

۴. The object of providing for the participation in the negotiations of any contracting party with a principle supplying interest, in addition to any contracting party with which the concession was originally negotiated, is to ensure that a contracting party with a larger share in the trade affected by the concession than a contracting party with which the concession was originally negotiated shall have an effective opportunity to protect the contractual right which it enjoys under this Agreement. On the other hand, it is not intended that the scope of the negotiations should be such as to make negotiations and agreement under Article XXVIII unduly difficult nor to create complications in the application of this Article in the future to concessions which result from negotiations thereunder. Accordingly, the CONTRACTING PARTIES PARTIES should only determine that a contracting party has a principal supplying interest if that contracting party has had, over a reasonable period of time prior to the negotiations, a larger share in the market of the applicant contracting party than a contracting party with which the concession was initially negotiated or would, in the judgement of the CONTRACTING PARTIES PARTIES, have had such a share in the absence of discriminatory quantitative restrictions maintained by the applicant contracting party. It would therefore not be appropriate for the CONTRACTING PARTIES PARTIES to determine that more than one contracting party, or in those exceptional cases where there is near equality more than two contracting parties, had a principal supplying interest.

۵. Notwithstanding the definition of a principal supplying interest in note ۴ to paragraph ۱, the CONTRACTING PARTIES PARTIES may exceptionally determine that a contracting party has a principal supplying interest if the concession in question affects trade which constitutes a major part of the total exports of such contracting party.

۶. It is not intended that provision for participation in the negotiations of any contracting party with a principal supplying interest, and for consultation with any contracting party having a substantial interest in the concession which the applicant contracting party is seeking to modify or withdraw, should have the effect that it should have to pay compensation or suffer retaliation greater than the withdrawal or modification sought, judged in the light of the conditions of trade at the time of the proposed withdrawal or modification, making allowance for any discriminatory quantitative restrictions maintained by the applicant contracting party.

۷. The expression "substantial interest" is not capable of a precise definition and accordingly may present difficulties for the CONTRACTING PARTIES PARTIES. It is, however, intended to be construed to cover only those contracting parties which have, or in the absence of discriminatory quantitative restrictions affecting their exports could reasonably be expected to have, a significant share in the market of the contracting party seeking to modify or withdraw the concession.

Paragraph ۴

۱. Any request for authorization to enter into negotiations shall be accompanied by all relevant statistical and other data. A decision on such request shall be made within thirty days of its submission.

۲. It is recognized that to permit certain contracting parties, depending in large measure on a relatively small number of primary commodities and relying on the tariff as an important aid for furthering diversification of their economies or as an important source of revenue, normally to negotiate for the modification or withdrawal of concessions only under paragraph ۱ of Article XXVIII, might cause them at such a time to make modifications or withdrawals which in the long run would prove unnecessary. To avoid such a situation the CONTRACTING PARTIES PARTIES shall authorize any such contracting party, under paragraph ۴, to enter into negotiations unless they consider this would result in, or contribute substantially towards, such an increase in tariff levels as to threaten the stability of the Schedules to this Agreement or lead to undue disturbance of international trade.

۳. It is expected that negotiations authorized under paragraph ۴ for modification or withdrawal of a single item, or a very small group of items, could normally be brought to a conclusion in sixty days. It is recognized, however, that such a period will be inadequate for cases involving negotiations for the modification or withdrawal of a larger number of items and in such cases, therefore, it would be appropriate for the CONTRACTING PARTIES PARTIES to prescribe a longer period.

۴. The determination referred to in paragraph ۴ (d) shall be made by the CONTRACTING PARTIES PARTIES within thirty days of the submission of the matter to them, unless the applicant contracting party agrees to a longer period.

۵. In determining under paragraph ۴ (d) whether an applicant contracting party has unreasonably failed to offer adequate compensation, it is understood that the CONTRACTING PARTIES PARTIES will take due account of the special position of a contracting party which has bound a high proportion of its tariffs at very low rates of duty and to this extent has less scope than other contracting parties to make compensatory adjustment.

Ad Article XXVIII bis

Paragraph ۳

It is understood that the reference to fiscal needs would include the revenue aspect of duties and particularly duties imposed primarily for revenue purposes or duties imposed on products which can be substituted for products subject to revenue duties to prevent the avoidance of such duties.

Ad Article XXIX

Paragraph ۱

Chapters VII and VIII of the Havana Charter have been excluded from paragraph ۱ because they generally deal with the organization, functions and procedures of the International Trade Organization.

Ad Part IV

The words "developed contracting parties" and the words "less-developed contracting parties" as used in Part IV are to be understood to refer to developed and less-developed countries which are parties to the General Agreement on Tariffs and Trade.

Ad Article XXXVI

Paragraph ۱

This Article is based upon the objectives set forth in Article I as it will be amended by Section A of paragraph ۱ of the Protocol Amending Part I and Articles XXIX and XXX when that Protocol enters into force.

Paragraph ۴

The term "primary products" includes agricultural products, vide paragraph ۲ of the note ad Article XVI, Section B.

Paragraph ۵

A diversification programme would generally include the intensification of activities for the processing of primary products and the development of manufacturing industries, taking into account the situation of the particular contracting party and the world outlook for production and consumption of different commodities.

Paragraph ۸

It is understood that the phrase "do not expect reciprocity" means, in accordance with the objectives set forth in this Article, that the less-developed contracting parties should not be expected, in the course of trade negotiations, to make contributions which are inconsistent with their individual development, financial and trade needs, taking into consideration past trade developments.

This paragraph would apply in the event of action under Section A of Article XVIII, Article XXVIII, Article XXVIII bis (Article XXIX after the amendment set forth in Section A of paragraph ۱ of the Protocol Amending Part I and Articles XXIX and XXX shall have become effective), Article XXXIII, or any other procedure under this Agreement.

Ad Article XXXVII

Paragraph ۱ (a)

This paragraph would apply in the event of negotiations for reduction or elimination of tariffs or other restrictive regulations of commerce under Articles XXVIII, XXVIII bis (XXIX after the amendment set forth in Section A of paragraph ۱ of the Protocol Amending Part I and Articles XXIX and XXX shall have become effective), and Article XXXIII, as well as in connection with other action to effect such reduction or elimination which contracting parties may be able to undertake.

Paragraph ۳(b)

The other measures referred to in this paragraph might include steps to promote domestic structural changes, to encourage the consumption of particular products, or to introduce measures of trade promotion.
