۱- سازمان جهانی تجارت دارای شخصیت حقوقی خواهد بود و هریک از اعضا صلاحیت حقوقی لازم را برای انجام وظایفش به آن اعطا خواهند کرد.
۲- هریک از اعضا به سازمان جهانی تجارت مزایا و مصونیت‌های لازم را برای انجام وظایفش اعطا خواهند کرد.
۳- هریک از اعضا به مقامات سازمان جهانی تجارت و نمایندگان اعضا، مزایا و مصونیت‌های لازم را برای انجام مستقل وظایفشان در ارتباط با سازمان جهانی تجارت، اعطا خواهند کرد.
۴- مزایا و مصونیت‌هایی که یک عضو به سازمان جهانی تجارت، مقامات آن و نمایندگان اعضای آن اعطا می‌کند مشابه مزایا و مصونیت‌هایی خواهد بود که در کنوانسیون مزایا و مصونیت‌های کارگزاری‌های تخصصی، مصوب مجمع عمومی سازمان ملل متحد در ۲۱ نوامبر ۱۹۴۷، مقرر شده است.
۵- سازمان جهانی تجارت می‌تواند یک موافقت‌نامه مقرّ منعقد سازد.
۱.The WTO shall have legal personality, and shall be accorded by each of its Members such legal capacity as may be necessary for the exercise of its functions.
۲.The WTO shall be accorded by each of its Members such privileges and immunities as are necessary for the exercise of its functions.
۳.The officials of the WTO and the representatives of the Members shall similarly be accorded by each of its Members such privileges and immunities as are necessary for the independent exercise of their functions in connection with the WTO.
۴.The privileges and immunities to be accorded by a Member to the WTO, its officials, and the representatives of its Members shall be similar to the privileges and immunities stipulated in the Convention on the Privileges and Immunities of the Specialized Agencies, approved by the General Assembly of the United Nations on ۲۱ November ۱۹۴۷.
۵.The WTO may conclude a headquarters agreement.
