۱. دیوان بینالمللی دادگستری باید اختیارات خود را در جلسه علنی انجام دهد مگر این که به موجب این اساسنامه غیر از این تصریح شده باشد.
۲. با قید این که عده قضات حاضر برای تشکیل دیوان بینالمللی دادگستری به کمتر از دوازده نرسد نظامنامه دیوان مزبور میتواند مقرر دارد که یک یا چند نفر از قضات به نوبت و برحسب اوضاع ممکن است از شرکت در جلسات معاف گردند.
۳. برای این که دیوان بتواند تشکیل گردد حد نصاب نه نفر کافی خواهد بود.
۱. The full Court shall sit except when it is expressly provided otherwise in the present Statute.
۲. Subject to the condition that the number of judges available to constitute the Court is not thereby reduced below eleven, the Rules of the Court may provide for allowing one or more judges, according to circumstances and in rotation, to be dispensed from sitting.
۳. A quorum of nine judges shall suffice to constitute the Court.
