۱- در صورتیکه طرفهای اختلافی از آنگونه که در ماده ۳۳ بدان اشاره شده است نتوانند آن را به وسایل مذکور در ماده مزبور حل و فصل کنند باید آن را به شورای امنیت ارجاع نمایند.
۲- هرگاه شورای امنیت تشخیص دهد که دوام یک اختلاف در واقع محتمل است حفظ صلح و امنیت بینالمللی را به خطر اندازد باید تصمیم بگیرد که بر طبق ماده ۳۶ عمل کند یا شرایطی را که برای حل و فصل مناسب تشخیص میدهد توصیه نماید.
۱. Should the parties to a dispute of the nature referred to in Article ۳۳ fail to settle it by the means indicated in that Article, they shall refer it to the Security Council.
۲. If the Security Council deems that the continuance of the dispute is in fact likely to endanger the maintenance of international peace and security, it shall decide whether to take action under Article ۳۶ or to recommend such terms of settlement as it may consider appropriate.
