۱ - هر دولت شرایط اعطای تابعیت خود به کشتیها، ثبت کشتیها در قلمرو خود و برخورداری آنها از حق برافراشتن پرچم آن دولت را تعیین میکند. کشتیها دارای تابعیت دولتی هستند که حق برافراشتن پرچم آن را دارند. میان دولت و کشتی باید رابطهای واقعی و مؤثر وجود داشته باشد.
۲ - هر دولت باید برای کشتیهایی که حق برافراشتن پرچم خود را به آنها اعطا کرده است، اسناد مثبِت این امر را صادر کند.
۱. Every State shall fix the conditions for the grant of its nationality to ships, for the registration of ships in its territory, and for the right to fly its flag. Ships have the nationality of the State whose flag they are entitled to fly. There must exist a genuine link between the State and the ship.
۲. Every State shall issue to ships to which it has granted the right to fly its flag documents to that effect.
