۱۸ - Article XVIII — Governmental Assistance to Economic Development - ماده ۱۸ — کمک دولتی به توسعه اقتصادی

۱. طرفهای متعاهد اذعان دارند که دستیابی به اهداف این موافقتنامه با توسعه تدریجی اقتصادهای آنها تسهیل خواهد شد، به ویژه آن دسته از طرفهای متعاهدی که اقتصاد آنها فقط می توانند از استانداردهای پایین زندگی پشتیبانی کنند و در مراحل اولیه توسعه هستند.

۲. طرف‌های متعاهد همچنین اذعان دارند که ممکن است برای آن طرف‌های متعاهد به منظور اجرای برنامه‌ها و سیاست‌های توسعه اقتصادی که برای ارتقای سطح عمومی زندگی مردم طراحی شده‌اند، اقدامات حفاظتی یا سایر اقدامات مؤثر بر واردات انجام دهند، و این اقدامات تا آنجا که دستیابی به اهداف این موافقتنامه را تسهیل می‌کند، موجه است. بنابراین، آنها توافق می‌کنند که آن طرف‌های متعاهد باید از تسهیلات اضافی برخوردار شوند تا بتوانند (الف) انعطاف‌پذیری کافی در ساختار تعرفه‌ای خود را حفظ کنند تا بتوانند حمایت تعرفه‌ای لازم برای ایجاد یک صنعت خاص را اعطا کنند و (ب) محدودیت‌های کمی را برای اهداف تراز پرداخت‌ها به‌گونه‌ای اعمال کنند که سطح بالای تقاضا برای واردات را که احتمالاً توسط برنامه‌های توسعه اقتصادی آنها ایجاد می‌شود، در نظر بگیرد.

۳. طرف‌های متعاهد در نهایت اذعان دارند که با آن تسهیلات اضافی که در بخش‌های الف و ب این ماده پیش‌بینی شده است، مفاد این موافقت‌نامه معمولاً برای قادر ساختن طرف‌های متعاهد برای برآوردن الزامات توسعه اقتصادی خود کافی است. با این حال، آنها موافقند که ممکن است شرایطی وجود داشته باشد که هیچ اقدامی مطابق با آن مفاد عملی نباشد که به یک طرف متعاهد در روند توسعه اقتصادی اجازه دهد کمک های دولتی لازم برای ترویج ایجاد صنایع خاص را با هدف ارتقای سطح عمومی زندگی مردم اعطا کند. رویه‌های ویژه‌ای در بخش‌های ج و د این ماده برای رسیدگی به آن موارد تعیین شده است.

۴. الف) در نتیجه، طرف متعاهدی که اقتصاد آن فقط می‌تواند از استانداردهای پایین زندگی پشتیبانی کند و در مراحل اولیه توسعه است، می‌تواند به طور موقت از مفاد سایر مواد این موافقت‌نامه، همانطور که در بخش‌های الف، ب و ج این ماده پیش‌بینی شده است، انحراف داشته باشد.

ب) طرف متعاهدی که اقتصاد آن در حال توسعه است اما در محدوده بند (الف) فوق قرار نمی گیرد، می تواند طبق بخش د این ماده درخواست هایی را به طرف های متعاهد ارسال کند.

۵. طرف‌های متعاهد تشخیص می‌دهند که درآمدهای صادراتی طرف‌های متعاهدی که اقتصاد آنها از نوع توصیف‌شده در بند ۴ (الف) و (ب) بالا است و به صادرات تعداد کمی از کالاهای اولیه وابسته است، ممکن است با کاهش فروش این کالاها به طور جدی کاهش یابد. بر این اساس، هنگامی که صادرات کالاهای اولیه توسط چنین طرف متعاهدی به طور جدی تحت تأثیر اقدامات انجام شده توسط طرف متعاهد دیگر قرار گیرد، ممکن است به مفاد مشورتی ماده بیست و دوم این موافقتنامه متوسل شود.

۶. طرفهای متعاهد باید همه اقدامات اعمال شده بر اساس مفاد بخش C و D این ماده را سالانه بررسی کنند. بخش A ۷. (الف) اگر طرف متعاهدی که در محدوده بند ۴ (الف) این ماده قرار دارد، به منظور ترویج استقرار یک صنعت خاص با هدف ارتقای سطح عمومی زندگی مردم آن، اصلاح یا لغو امتیاز مندرج در جدول مناسب ضمیمه این موافقت‌نامه را مطلوب بداند، باید به طرف‌های متعاهد با هر طرف قراردادی وارد مذاکره شود. که در ابتدا چنین امتیازی مورد مذاکره قرار گرفت و با هر طرف متعاهد دیگری که توسط طرفهای متعاهد تعیین شده بود که منافع قابل توجهی در آن داشته باشد. در صورت حصول توافق بین طرفین متعاهد ذینفع، آنها آزاد خواهند بود تا امتیازات را طبق جدول‌های مربوط به این موافقتنامه اصلاح یا لغو کنند تا به چنین توافقی، از جمله هرگونه تعدیلات جبرانی مربوط، عملی شود. (ب) در صورتی که ظرف شصت روز پس از اطلاعیه مندرج در بند (الف) فوق توافق حاصل نشود، طرف متعاهدی که پیشنهاد اصلاح یا پس گرفتن امتیاز را دارد، می‌تواند موضوع را به طرفهای متعاهد ارجاع دهد که فوراً آن را بررسی خواهند کرد. اگر آنها متوجه شوند که طرف متعاهدی که پیشنهاد تعدیل یا پس گرفتن امتیاز را دارد، تمام تلاش خود را برای دستیابی به توافق انجام داده و تعدیل جبرانی ارائه شده توسط آن کافی است، آن طرف متعاهد مختار است که امتیاز را تعدیل یا پس بگیرد، اگر در همان زمان، تعدیل جبرانی را اجرا کند. اگر طرفهای متعاهد دریافتند که غرامت ارائه شده توسط طرف متعاهدی که پیشنهاد تعدیل یا پس گرفتن امتیاز را دارد، کافی نیست، اما متوجه شوند که تمام تلاش منطقی را برای ارائه غرامت کافی انجام داده است، آن طرف متعاهد مختار خواهد بود که نسبت به اصلاح یا عقب نشینی اقدام کند. در صورت انجام چنین اقدامی، هر طرف متعاهد دیگری که در بند (الف) فوق ذکر شده است، آزاد خواهد بود که امتیازات تقریباً معادلی را که در ابتدا با طرف متعاهدی که اقدام را انجام داده است، اصلاح یا پس بگیرد. بخش ب ۸. طرف‌های متعاهد تشخیص می‌دهند که طرف‌های متعاهدی که در محدوده بند (الف) بند ۴ این ماده قرار می‌گیرند، زمانی که در روند توسعه سریع هستند، معمولاً با مشکلاتی در تراز پرداخت‌ها مواجه می‌شوند که عمدتاً ناشی از تلاش‌ها برای گسترش بازارهای داخلی خود و همچنین از بی‌ثباتی شرایط تجارتشان است.

۹. به ترتیب برای حفظ وضعیت مالی خارجی خود و برای اطمینان از سطح ذخایر مناسب برای اجرای برنامه توسعه اقتصادی خود، طرف متعاهدی که در محدوده بند (الف) بند ۴ این ماده قرار می گیرد، می تواند با رعایت مفاد بندهای ۱۰ تا ۱۲، سطح عمومی واردات خود را با محدود کردن مقدار یا ارزش کالای مجاز وارداتی کنترل کند. مشروط بر اینکه محدودیت‌های وارداتی اعمال‌شده، حفظ یا تشدید شده از موارد ضروری تجاوز نکند: برای جلوگیری از تهدید یا توقف کاهش جدی ذخایر پولی خود، یا در مورد یک طرف متعاهد با ذخایر پولی ناکافی، برای دستیابی به نرخ معقول افزایش ذخایر خود. در هر صورت باید به عوامل خاصی که ممکن است بر ذخایر طرف متعاهد یا نیاز آن به ذخایر تأثیر بگذارد، توجه لازم مبذول خواهد شد، از جمله، در مواردی که اعتبارات خارجی خاص یا سایر منابع در دسترس آن باشد، نیاز به تأمین استفاده مناسب از این اعتبارات یا منابع.

۱۰. در اعمال این محدودیت‌ها، طرف متعاهد می‌تواند میزان تأثیر آنها را بر واردات محصولات یا طبقات مختلف محصولات به گونه‌ای تعیین کند که واردات محصولاتی را که در پرتو سیاست توسعه اقتصادی آن ضروری‌تر هستند، اولویت دهد. مشروط بر اینکه محدودیت‌ها به گونه‌ای اعمال شوند که از آسیب‌های غیرضروری به منافع تجاری یا اقتصادی هر یک از طرف‌های متعاهد دیگر جلوگیری شود و از واردات نامعقول هر گونه توصیف کالایی در حداقل مقادیر تجاری که کنار گذاشتن آن به کانال‌های منظم تجارت لطمه وارد کند، ممانعت به عمل نیاید. و مشروط بر این که محدودیت ها به گونه ای اعمال نمی شوند که مانع از واردات نمونه های تجاری یا جلوگیری از انطباق با ثبت اختراع، علامت تجاری، حق چاپ یا رویه های مشابه شود.

۱۱. طرف متعاهد مربوطه در اجرای سیاست‌های داخلی خود باید به نیاز به بازگرداندن تعادل در تراز پرداخت‌های خود بر مبنایی سالم و پایدار و مطلوبیت تضمین اشتغال اقتصادی منابع تولیدی توجه لازم را داشته باشد. با بهبود شرایط، به تدریج هرگونه محدودیت اعمال شده تحت این بخش را کاهش خواهد داد و آنها را فقط تا حدی که طبق شرایط بند ۹ این ماده ضروری است حفظ می کند و زمانی که شرایط دیگر چنین نگهداری را توجیه نمی کند، آنها را حذف خواهد کرد. مشروط بر اینکه هیچ طرف متعاهدی ملزم به لغو یا تعدیل محدودیت ها نخواهد بود به این دلیل که تغییر در خط مشی توسعه آن محدودیت هایی را که طبق این بند اعمال می کند غیرضروری می کند.

۱۲. (الف) هر طرف متعاهدی که محدودیت‌های جدیدی را اعمال کند یا سطح کلی محدودیت‌های موجود خود را با تشدید قابل‌توجه اقدامات اعمال شده در این بخش افزایش دهد. باید بلافاصله پس از ایجاد یا تشدید چنین محدودیت‌هایی (یا در شرایطی که مشاوره قبلی عملی است، قبل از انجام آن) با طرف‌های متعاهد در مورد ماهیت مشکلات تراز پرداخت‌ها، اقدامات اصلاحی جایگزینی که ممکن است در دسترس باشد و تأثیر احتمالی محدودیت‌ها بر اقتصاد سایر طرف‌های متعاهد مشورت کند. (ب) در تاریخی که توسط آنها تعیین خواهد شد، طرفهای متعاهد باید تمام محدودیت‌هایی را که همچنان تحت این بخش در آن تاریخ اعمال می‌شوند، بررسی کنند. از دو سال پس از آن تاریخ، طرف‌های متعاهدی که محدودیت‌هایی را به موجب این بخش اعمال می‌کنند، طبق برنامه‌ای که هر سال توسط طرف‌های متعاهد تهیه می‌شود، در فواصل زمانی تقریبی، اما نه کمتر از دو سال، با طرف‌های متعاهد از نوع پیش‌بینی‌شده در جزء (الف) بالا وارد رایزنی خواهند شد. مشروط بر اینکه هیچ مشورتی بر اساس این بند ظرف دو سال پس از خاتمه مشاوره با ماهیت کلی بر اساس سایر مقررات این بند صورت نگیرد. (ج) (i) اگر در جریان مشاوره با یک طرف متعاهد طبق بند (الف) یا (ب) این بند، طرفین متعاهد متوجه شوند که محدودیت‌ها با مفاد این بخش یا با مفاد ماده سیزدهم (موضوع مفاد ماده چهاردهم) مطابقت ندارد، ممکن است ماهیت این ناسازگاری را به‌طور مناسبی محدود کرده و توصیه کنند. (دوم) اگر در نتیجه مشورت‌ها، طرف‌های متعاهد تشخیص دهند که محدودیت‌ها به نحوی اعمال می‌شوند که مستلزم مغایرت شدید ماهیت با مفاد این بخش یا با مفاد ماده سیزدهم (با رعایت مفاد ماده چهاردهم) باشد و خسارت به تجارت هر یک از طرف‌های متعاهد توسط طرف متعاهد ایجاد شده یا تهدید شود، باید آن را محدود کنند. ارائه توصیه های مناسب برای تضمین انطباق با این مقررات در یک دوره مشخص. اگر چنین طرف متعاهدی در مدت مشخص شده از این توصیه‌ها پیروی نکند، طرف‌های متعاهد می‌توانند هر طرف متعاهدی را که تجارت آن تحت تأثیر محدودیت‌ها قرار گرفته است را از چنین تعهداتی به موجب این موافقت‌نامه نسبت به طرف متعاهدی که محدودیت‌ها را مطابق با شرایط مناسب تشخیص می‌دهند، آزاد کنند. (د) طرفهای متعاهد از هر طرف متعاهدی که طبق این بخش محدودیت‌هایی اعمال می‌کند دعوت می‌کنند تا بنا به درخواست هر طرف متعاهدی که می‌تواند در ابتدا ثابت کند که محدودیت‌ها با مفاد این بخش یا با مفاد ماده سیزدهم (با رعایت مفاد ماده چهاردهم) مغایرت دارد، با آنها مشورت کند. و تجارت آن تحت تأثیر نامطلوب قرار می گیرد. با این حال، هیچ دعوتنامه ای صادر نمی شود مگر اینکه طرف های متعاهد اطمینان حاصل کنند که گفتگوهای مستقیم بین طرف های متعاهد مربوطه موفقیت آمیز نبوده است. چنانچه در نتیجه رایزنی با طرفین متعاهد، توافقی حاصل نشد و آنها تشخیص دهند که محدودیت ها مغایر با این مقررات اعمال می شود و از این طریق خسارتی به تجارت طرف متعاهد آغاز کننده رویه وارد شده یا تهدید می شود، لغو یا تعدیل محدودیت ها را توصیه می کنند. اگر محدودیت‌ها در مدت زمانی که طرف‌های متعاهد مقرر می‌کنند لغو یا اصلاح نشوند، می‌توانند طرف متعاهدی را که رویه را آغاز می‌کند از چنین تعهداتی به موجب این موافقت‌نامه در قبال طرف متعاهدی که محدودیت‌ها را مطابق با شرایط مناسب تشخیص می‌دهند، رها کنند.

ث) اگر طرف متعاهدی که طبق آخرین جمله بند (ج) (د) یا (د) این بند اقدامی علیه آن انجام شده است، تشخیص دهد که آزادسازی تعهدات مجاز طرف‌های متعاهد بر عملکرد برنامه و سیاست توسعه اقتصادی خود تأثیر منفی می‌گذارد، حداکثر تا شصت روز پس از انجام چنین اقدامی، آزاد خواهد بود تا اخطار محرمانه خود را به طرفین صادر کند. قصد خروج از این توافقنامه و چنین خروجی در شصتمین روز پس از روز دریافت اخطار توسط وی اعمال خواهد شد. (و) در اقدام طبق این بند، طرفهای متعاهد باید به عوامل مذکور در بند ۲ این ماده توجه کافی داشته باشند. تصمیمات مندرج در این بند باید به سرعت و در صورت امکان ظرف شصت روز پس از شروع مشاوره انجام شود. بخش ج ۱۳. اگر طرف متعاهدی که در محدوده بند (الف) بند ۴ این ماده قرار دارد، تشخیص دهد که برای ارتقای استقرار صنعت خاصی با هدف ارتقای سطح عمومی زندگی مردم آن، کمک دولتی لازم است، اما هیچ اقدامی مطابق با سایر مفاد این موافقت‌نامه برای دستیابی به آن هدف عملی نیست، ممکن است در این بخش از مقررات و رویه‌هایی استفاده کند.

۱۴. طرف متعاهد مربوطه باید طرفهای متعاهد را از مشکلات ویژه ای که در دستیابی به هدف مندرج در بند ۱۳ این ماده با آن مواجه می شود مطلع کند و اقدامات خاصی را که بر واردات پیشنهاد می کند به منظور رفع این مشکلات معرفی کند، مشخص خواهد کرد. قبل از انقضای مهلت مقرر در بند ۱۵ یا ۱۷، حسب مورد، یا اگر این اقدام بر واردات کالا تأثیر بگذارد، نباید آن اقدام را انجام دهد. محصولی که موضوع امتیازی است که در جدول مناسب ضمیمه این موافقتنامه گنجانده شده است، مگر اینکه موافقت طرفهای متعاهد را مطابق با مفاد بند ۱۸ تضمین کرده باشد. مشروط بر اینکه اگر صنعت دریافت‌کننده کمک قبلاً تولید را شروع کرده باشد، طرف قرارداد می‌تواند پس از اطلاع طرف‌های متعاهد، اقدامات لازم را برای جلوگیری از افزایش قابل‌توجه واردات محصول یا محصولات مورد نظر در طی آن دوره به بالاتر از حد معمول انجام دهد.

۱۵. اگر ظرف ۳۰ روز پس از ابلاغ اقدام، طرفهای متعاهد از طرف متعاهد مربوطه درخواست نکنند که با آنها مشورت کند، آن طرف متعاهد مختار است از مفاد مربوطه سایر مواد این موافقتنامه تا حدی که برای اعمال اقدام پیشنهادی لازم است عدول کند.

۱۶. در صورت درخواست طرفهای متعاهد برای انجام این کار، طرف متعاهد مربوطه در مورد هدف اقدام پیشنهادی، در مورد اقدامات جایگزینی که ممکن است تحت این موافقتنامه در دسترس باشد، و در مورد تأثیر احتمالی اقدام پیشنهادی بر منافع تجاری و اقتصادی سایر طرف‌های متعاهد با آنها مشورت خواهد کرد. اگر در نتیجه چنین مشورتی، طرفهای متعاهد موافقت کنند که هیچ اقدامی مطابق با سایر مفاد این موافقتنامه که برای دستیابی به هدف مندرج در بند ۱۳ این ماده عملی باشد وجود ندارد و با اقدام پیشنهادی موافق باشند، طرف متعاهد مربوطه از تعهدات خود بر اساس مقررات مربوطه اقدامات لازم در سایر مواد این موافقتنامه برای اعمال آن رها خواهد شد.

۱۷. در صورتی که ظرف نود روز پس از تاریخ ابلاغ اقدام پیشنهادی طبق بند ۱۴ این ماده، طرفهای متعاهد با چنین اقدامی موافقت نکرده باشند، طرف متعاهد مربوط می‌تواند پس از اطلاع به طرفین متعاهد، اقدام پیشنهادی را معرفی کند.

۱۸. اگر اقدام پیشنهادی محصولی را تحت تأثیر قرار دهد که موضوع امتیاز مندرج در جدول مناسب ضمیمه این موافقتنامه است، طرف متعاهد مربوطه باید با هر طرف متعاهد دیگری که امتیاز اولیه با آن مذاکره شده است، و با هر طرف متعاهد دیگری که توسط طرفهای متعاهد تعیین شده است تا منافع قابل توجهی در آن داشته باشد، وارد مشورت شود. طرفهای متعاهد در صورتی با این اقدام موافقت خواهند کرد که توافق کنند هیچ اقدامی مطابق با سایر مفاد این موافقتنامه که برای دستیابی به هدف مندرج در بند ۱۳ این ماده عملی باشد وجود ندارد و در صورت رضایت: آن توافق با سایر طرف‌های متعاهد در نتیجه رایزنی‌های ذکر شده در بالا حاصل شده است یا اگر چنین نشده باشد. ظرف شصت روز پس از دریافت اطلاعیه مندرج در بند ۱۴ توسط طرف‌های متعاهد، توافق شده است که طرف متعاهدی که به این بخش مراجعه می‌کند، تمام تلاش‌های منطقی را برای دستیابی به توافق انجام داده و از منافع سایر طرف‌های متعاهد به اندازه کافی محافظت می‌شود. طرف متعاهدی که به این بخش متوسل می شود، پس از آن از تعهدات خود بر اساس مفاد مربوطه سایر مواد این موافقتنامه تا حدی که به او اجازه می دهد تا این اقدام را اعمال کند، رها خواهد شد.

۱۹. اگر اقدام پیشنهادی از نوع تشریح شده در بند ۱۳ این ماده مربوط به صنعتی باشد که تأسیس آن در دوره اولیه با حمایت اتفاقی ناشی از محدودیت‌های اعمال شده توسط طرف متعاهد مربوطه برای اهداف تراز پرداخت‌ها طبق مفاد مربوطه این موافقتنامه تسهیل شده است، آن طرف متعاهد می‌تواند به مفاد و رویه‌های این بخش متوسل شود. مشروط بر اینکه اقدام پیشنهادی را بدون موافقت طرفهای متعاهد اعمال نکند.

۲۰. هیچ یک از بندهای قبل از این بخش اجازه انحراف از مفاد مواد I، II و XIII این موافقتنامه را نمی دهد. مفاد بند ۱۰ این ماده برای هر محدودیتی که در این بخش آمده است نیز قابل اعمال خواهد بود.

۲۱. در هر زمانی که اقدامی بر اساس بند ۱۷ این ماده اعمال می شود، هر طرف متعاهدی که اساساً تحت تأثیر آن قرار می گیرد، می تواند اعمال این بخش را برای تجارت طرف متعاهدی که به این بخش متوسل می شود، از چنین امتیازات تقریباً معادل یا سایر تعهدات تحت این موافقتنامه که تعلیق آن توسط طرفین متعاهد مخالف است، معلق کند. مشروط بر اینکه اخطار شصت روزه این تعلیق به طرفهای متعاهد حداکثر شش ماه پس از معرفی یا تغییر اساسی به ضرر طرف متعاهد متعاهد ارسال شود. هر یک از این طرفهای متعاهد باید فرصت کافی را برای مشاوره مطابق با مفاد ماده بیست و دوم این موافقتنامه فراهم کند. بخش د ۲۲. یک طرف متعاهدی که در محدوده بند ۴ (ب) این ماده قرار دارد و به نفع توسعه اقتصاد خود می‌خواهد اقدامی از نوع توصیف شده در بند ۱۳ این ماده در رابطه با ایجاد یک صنعت خاص معرفی کند، می‌تواند برای تصویب چنین اقدامی از طرف‌های متعاهد درخواست کند. طرفهای متعاهد فوراً با چنین طرف متعاهدی مشورت خواهند کرد و در تصمیم گیری خود، بر اساس ملاحظات مندرج در بند ۱۶ هدایت خواهند شد. مفاد مرتبط سایر مواد این موافقتنامه تا حدی که به آن اجازه می دهد تا این اقدام را اعمال کند. اگر اقدام پیشنهادی محصولی را تحت تأثیر قرار دهد که موضوع امتیاز مندرج در جدول مناسب ضمیمه این موافقتنامه است، مفاد بند ۱۸ اعمال خواهد شد.

۲۳. هر اقدامی که به موجب این بخش اعمال شود باید با مفاد بند ۲۰ این ماده مطابقت داشته باشد.

۱. The contracting parties recognize that the attainment of the objectives of this Agreement will be facilitated by the progressive development of their economies, particularly of those contracting parties the economies of which can only support low standards of living and are in the early stages of development.

۲. The contracting parties recognize further that it may be necessary for those contracting parties, in order to implement programmes and policies of economic development designed to raise the general standard of living of their people, to take protective or other measures affecting imports, and that such measures are justified in so far as they facilitate the attainment of the objectives of this Agreement. They agree, therefore, that those contracting parties should enjoy additional facilities to enable them (a) to maintain sufficient flexibility in their tariff structure to be able to grant the tariff protection required for the establishment of a particular industry and (b) to apply quantitative restrictions for balance of payments purposes in a manner which takes full account of the continued high level of demand for imports likely to be generated by their programmes of economic development.

۳. The contracting parties recognize finally that with those additional facilities which are provided for in Sections A and B of this Article, the provisions of this Agreement would normally be sufficient to enable contracting parties to meet the requirements of their economic development. They agree, however, that there may be circumstances where no measure consistent with those provisions is practicable to permit a contracting party in the process of economic development to grant the governmental assistance required to promote the establishment of particular industries with a view to raising the general standard of living of its people. Special procedures are laid down in Sections C and D of this Article to deal with those cases.

۴. (a) Consequently, a contracting party the economy of which can only support low standards of living and is in the early stages of development shall be free to deviate temporarily from the provisions of the other Articles of this Agreement, as provided in Sections A, B and C of this Article.

(b) A contracting party, the economy of which is in the process of development but which does not come within the scope of sub-paragraph (a) above, may submit applications to the CONTRACTING PARTIES PARTIES under Section D of this Article.

۵. The contracting parties recognize that the export earnings of contracting parties the economies of which are of the type described in paragraph ۴ (a) and (b) above and which depend on exports of a small number of primary commodities may be seriously reduced by a decline in the sale of such commodities. Accordingly, when the exports of primary commodities by such a contracting party are seriously affected by measures taken by another contracting party, it may have resort to the consultation provisions of Article XXII of this Agreement.

۶. The CONTRACTING PARTIES PARTIES shall review annually all measures applied pursuant to the provisions of Sections C and D of this Article.

Section A

۷. (a) If a contracting party coming within the scope of paragraph ۴ (a) of this Article considers it desirable, in order to promote the establishment of a particular industry with a view to raising the general standard of living of its people, to modify or withdraw a concession included in the appropriate Schedule annexed to this Agreement, it shall notify the CONTRACTING PARTIES PARTIES to this effect and enter into negotiations with any contracting party with which such concession was initially negotiated, and with any other contracting party determined by the CONTRACTING PARTIES PARTIES to have a substantial interest therein. If agreement is reached between such contracting parties concerned, they shall be free to modify or withdraw concessions under the appropriate Schedules to this Agreement in order to give effect to such agreement, including any compensatory adjustments involved.

(b) If agreement is not reached within sixty days after the notification provided for in sub-paragraph (a) above, the contracting party which proposes to modify or withdraw the concession may refer the matter to the CONTRACTING PARTIES PARTIES which shall promptly examine it. If they find that the contracting party which proposes to modify or withdraw the concession has made every effort to reach an agreement and that the compensatory adjustment offered by it is adequate, that contracting party shall be free to modify or withdraw the concession if at the same time, it gives effect to the compensatory adjustment. If the CONTRACTING PARTIES PARTIES do not find that the compensation offered by a contracting party proposing to modify or withdraw the concession is adequate, but find that it has made every reasonable effort to offer adequate compensation, that contracting party shall be free to proceed with such modification or withdrawal. If such action is taken, any other contracting party referred to in sub-paragraph (a) above shall be free to modify or withdraw substantially equivalent concessions initially negotiated with the contracting party which has taken the action.

Section B

۸. The contracting parties recognize that contracting parties coming within the scope of paragraph ۴ (a) of this Article tend, when they are in rapid process of development, to experience balance of payments difficulties arising mainly from efforts to expand their internal markets as well as from the instability in their terms of trade.

۹. In order to safeguard its external financial position and to ensure a level of reserves adequate for the implementation of its programme of economic development, a contracting party coming within the scope of paragraph ۴ (a) of this Article may, subject to the provisions of paragraphs ۱۰ to ۱۲, control the general level of its imports by restricting the quantity or value of merchandise permitted to be imported; Provided that the import restrictions instituted, maintained or intensified shall not exceed those necessary:

to forestall the threat of, or to stop, a serious decline in its monetary reserves, or

in the case of a contracting party with inadequate monetary reserves, to achieve a reasonable rate of increase in its reserves.

Due regard shall be paid in either case to any special factors which may be affecting the reserves of the contracting party or its need for reserves, including, where special external credits or other resources are available to it, the need to provide for the appropriate use of such credits or resources.

۰. In applying these restrictions, the contracting party may determine their incidence on imports of different products or classes of products in such a way as to give priority to the importation of those products which are more essential in the light of its policy of economic development; Provided that the restrictions are so applied as to avoid unnecessary damage to the commercial or economic interests of any other contracting party and not to prevent unreasonably the importation of any description of goods in minimum commercial quantities the exclusion of which would impair regular channels of trade; and Provided further that the restrictions are not so applied as to prevent the importation of commercial samples or to prevent compliance with patent, trademark, copyright or similar procedures.

۱. In carrying out its domestic policies, the contracting party concerned shall pay due regard to the need for restoring equilibrium in its balance of payments on a sound and lasting basis and to the desirability of assuring an economic employment of productive resources. It shall progressively relax any restrictions applied under this Section as conditions improve, maintaining them only to the extent necessary under the terms of paragraph ۹ of this Article and shall eliminate them when conditions no longer justify such maintenance; Provided that no contracting party shall be required to withdraw or modify restrictions on the ground that a change in its development policy would render unnecessary the restrictions which it is applying under this Section.

۱۲. (a) Any contracting party applying new restrictions or raising the general level of its existing restrictions by a substantial intensification of the measures applied under this Section, shall immediately after instituting or intensifying such restrictions (or, in circumstances in which prior consultation is practicable, before doing so) consult with the CONTRACTING PARTIES PARTIES as to the nature of its balance of payments difficulties, alternative corrective measures which may be available, and the possible effect of the restrictions on the economies of other contracting parties.

(b) On a date to be determined by them the CONTRACTING PARTIES PARTIES shall review all restrictions still applied under this Section on that date. Beginning two years after that date, contracting parties applying restrictions under this Section shall enter into consultations of the type provided for in subparagraph (a) above with the CONTRACTING PARTIES PARTIES at intervals of approximately, but not less than, two years according to a programme to be drawn up each year by the CONTRACTING PARTIES PARTIES; Provided that no consultation under this sub-paragraph shall take place within two years after the conclusion of a consultation of a general nature under any other provision of this paragraph.

(c) (i) If, in the course of consultations with a contracting party under subparagraph (a) or (b) of this paragraph, the CONTRACTING PARTIES PARTIES find that the restrictions are not consistent with the provisions of this Section or with those of Article XIII (subject to the provisions of Article XIV), they shall indicate the nature of the inconsistency and may advise that the restrictions be suitably modified.

(ii) If, however, as a result of the consultations, the CONTRACTING PARTIES PARTIES determine that the restrictions are being applied in a manner involving an inconsistency of a serious nature with the provisions of this Section or with those of Article XIII (subject to the provisions of Article XIV) and that damage to the trade of any contracting party is caused or threatened thereby, they shall so inform the contracting party applying the restrictions and shall make appropriate recommendations for securing conformity with such provisions within a specified period. If such contracting party does not comply with these recommendations within the specified period, the CONTRACTING PARTIES PARTIES may release any contracting party the trade of which is adversely affected by the restrictions from such obligations under this Agreement towards the contracting party applying the restrictions as they determine to be appropriate in the circumstances.

(d) The CONTRACTING PARTIES PARTIES shall invite any contracting party which is applying restrictions under this Section to enter into consultations with them at the request of any contracting party which can establish a prima facie case that the restrictions are inconsistent with the provisions of this Section or with those of Article XIII (subject to the provisions of Article XIV) and that its trade is adversely affected thereby. However, no such invitation shall be issued unless the CONTRACTING PARTIES PARTIES have ascertained that direct discussions between the contracting parties concerned have not been successful. If, as a result of the consultations with the CONTRACTING PARTIES PARTIES no agreement is reached and they determine that the restrictions are being applied inconsistently with such provisions, and that damage to the trade of the contracting party initiating the procedure is caused or threatened thereby, they shall recommend the withdrawal or modification of the restrictions. If the restrictions are not withdrawn or modified within such time as the CONTRACTING PARTIES PARTIES may prescribe, they may release the contracting party initiating the procedure from such obligations under this Agreement towards the contracting party applying the restrictions as they determine to be appropriate in the circumstances.

(e) If a contracting party against which action has been taken in accordance with the last sentence of sub-paragraph (c) (ii) or (d) of this paragraph, finds that the release of obligations authorized by the CONTRACTING PARTIES PARTIES adversely affects the operation of its programme and policy of economic development, it shall be free, not later than sixty days after such action is taken, to give written notice to the Executive Secretary to the Contracting Parties of its intention to withdraw from this Agreement and such withdrawal shall take effect on the sixtieth day following the day on which the notice is received by him.

(f) In proceeding under this paragraph, the CONTRACTING PARTIES PARTIES shall have due regard to the factors referred to in paragraph ۲ of this Article. Determinations under this paragraph shall be rendered expeditiously and, if possible, within sixty days of the initiation of the consultations.

Section C

۳. If a contracting party coming within the scope of paragraph ۴ (a) of this Article finds that governmental assistance is required to promote the establishment of a particular industry with a view to raising the general standard of living of its people, but that no measure consistent with the other provisions of this Agreement is practicable to achieve that objective, it may have recourse to the provisions and procedures set out in this Section.

۴. The contracting party concerned shall notify the CONTRACTING PARTIES PARTIES of the special difficulties which it meets in the achievement of the objective outlined in paragraph ۱۳ of this Article and shall indicate the specific measure affecting imports which it proposes to introduce in order to remedy these difficulties. It shall not introduce that measure before the expiration of the time-limit laid down in paragraph ۱۵ or ۱۷, as the case may be, or if the measure affects imports of a product which is the subject of a concession included in the appropriate Schedule annexed to this Agreement, unless it has secured the concurrence of the CONTRACTING PARTIES PARTIES in accordance with provisions of paragraph ۱۸; Provided that, if the industry receiving assistance has already started production, the contracting party may, after informing the CONTRACTING PARTIES PARTIES, take such measures as may be necessary to prevent, during that period, imports of the product or products concerned from increasing substantially above a normal level.

۵. If, within thirty days of the notification of the measure, the CONTRACTING PARTIES PARTIES do not request the contracting party concerned to consult with them, that contracting party shall be free to deviate from the relevant provisions of the other Articles of this Agreement to the extent necessary to apply the proposed measure.

۶. If it is requested by the CONTRACTING PARTIES PARTIES to do so, the contracting party concerned shall consult with them as to the purpose of the proposed measure, as to alternative measures which may be available under this Agreement, and as to the possible effect of the measure proposed on the commercial and economic interests of other contracting parties. If, as a result of such consultation, the CONTRACTING PARTIES PARTIES agree that there is no measure consistent with the other provisions of this Agreement which is practicable in order to achieve the objective outlined in paragraph ۱۳ of this Article, and concur in the proposed measure, the contracting party concerned shall be released from its obligations under the relevant provisions of the other Articles of this Agreement to the extent necessary to apply that measure.

۷. If, within ninety days after the date of the notification of the proposed measure under paragraph ۱۴ of this Article, the CONTRACTING PARTIES PARTIES have not concurred in such measure, the contracting party concerned may introduce the measure proposed after informing the CONTRACTING PARTIES PARTIES.

۸. If the proposed measure affects a product which is the subject of a concession included in the appropriate Schedule annexed to this Agreement, the contracting party concerned shall enter into consultations with any other contracting party with which the concession was initially negotiated, and with any other contracting party determined by the CONTRACTING PARTIES PARTIES to have a substantial interest therein. The CONTRACTING PARTIES PARTIES shall concur in the measure if they agree that there is no measure consistent with the other provisions of this Agreement which is practicable in order to achieve the objective set forth in paragraph ۱۳ of this Article, and if they are satisfied:

that agreement has been reached with such other contracting parties as a result of the consultations referred to above, or

if no such agreement has been reached within sixty days after the notification provided for in paragraph ۱۴ has been received by the CONTRACTING PARTIES PARTIES, that the contracting party having recourse to this Section has made all reasonable efforts to reach an agreement and that the interests of other contracting parties are adequately safeguarded.

The contracting party having recourse to this Section shall thereupon be released from its obligations under the relevant provisions of the other Articles of this Agreement to the extent necessary to permit it to apply the measure.

۹. If a proposed measure of the type described in paragraph ۱۳ of this Article concerns an industry the establishment of which has in the initial period been facilitated by incidental protection afforded by restrictions imposed by the contracting party concerned for balance of payments purposes under the relevant provisions of this Agreement, that contracting party may resort to the provisions and procedures of this Section; Provided that it shall not apply the proposed measure without the concurrence of the CONTRACTING PARTIES PARTIES.

۰. Nothing in the preceding paragraphs of this Section shall authorize any deviation from the provisions of Articles I, II and XIII of this Agreement. The provisos to paragraph ۱۰ of this Article shall also be applicable to any restriction under this Section.

۱. At any time while a measure is being applied under paragraph ۱۷ of this Article any contracting party substantially affected by it may suspend the application to the trade of the contracting party having recourse to this Section of such substantially equivalent concessions or other obligations under this Agreement the suspenSion of which the CONTRACTING PARTIES PARTIES do not disapprove; Provided that sixty days' notice of such suspension is given to the CONTRACTING PARTIES PARTIES not later than six months after the measure has been introduced or changed substantially to the detriment of the contracting party affected. Any such contracting party shall afford adequate opportunity for consultation in accordance with the provisions of Article XXII of this Agreement.

Section D

۲. A contracting party coming within the scope of sub-paragraph ۴ (b) of this Article desiring, in the interest of the development of its economy, to introduce a measure of the type described in paragraph ۱۳ of this Article in respect of the establishment of a particular industry may apply to the CONTRACTING PARTIES PARTIES for approval of such measure. The CONTRACTING PARTIES PARTIES shall promptly consult with such contracting party and shall, in making their decision, be guided by the considerations set out in paragraph

۶. If the CONTRACTING PARTIES PARTIES concur in the proposed measure the contracting party concerned shall be released from its obligations under the relevant provisions of the other Articles of this Agreement to the extent necessary to permit it to apply the measure. If the proposed measure affects a product which is the subject of a concession included in the appropriate Schedule annexed to this Agreement, the provisions of paragraph ۱۸ shall apply.

۳. Any measure applied under this Section shall comply with the provisions of paragraph ۲۰ of this Article.
